Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSOP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed: Licensing; Physical Facility; Staffing; Polices & Procedures; Care & Supervision; Hygiene and Communicable Disease Control; Medication; Nutrition and Food Services; Program; Records and Reporting
As part of the Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation (CORRECTED DURING INSPECTION): During inspection Licensing noted that the manager's name is not displayed in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During inspection Licensing inspected the upstairs deck, which is sometimes used by the daycare children for outdoor play, and noted an area where the decking is lifting causing a tripping hazard.
Corrective Action(s): Ensure all areas of the decking are flat, and not lifting, to prevent tripping hazard.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): During inspection Licensing noted that baby wipes, in containers, were located on the floor in the mail play area.

Staff moved the wipes to an inaccessible area during inspection.
Corrective Action(s): Ensure wipes are inaccessible to children at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: During inspection Licensing tested the hot water in the washbasin and noted that it was 52C. Water temperature cannot exceed 49C to prevent scalding.

Manager stated that staff will observe children while they wash their hands until the water temperature is lowered.
Corrective Action(s): Ensure water accessible to children does not exceed 49C.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: During inspection Licensing discussed the new DoLSOP "Active Play" including "Screen Use" requirements with the staff team & neither was aware of all aspects of the requirement including: facilitated/ unfacilitated play and sedentary play.

Licensing had sent emails to the manager throughout 2017 with regard to the new DoLSOP requirements which were enforced beginning September 2017.

Licensing left further information with the manager regarding this at time of inspection.
Corrective Action(s): Ensure staff and parents are aware of the facility policies in place regarding the new DoLSOP "Active Play" and "Screen Use" policies.

HYGIENE AND COMMUNICABLE DISEASE: 15050 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation (CORRECTED DURING INSPECTION): During inspection Licensing noted that the diaper pad being used for multiple children is cloth and cannot be disinfected after each use.

During inspection manager removed the cloth covering leaving the vinyl pad for use which can be easily disinfected.
Corrective Action(s): Ensure that the diaper pad being used is of a material, such as vinyl, which can be disinfected after each child; or that individual diaper pads are used for each child and disinfected appropriately.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Upon arrival Licensing noted that not all children had been signed in, Licensing mentioned this to staff at that time, one hour later this had not been corrected. It was corrected after Licensing mentioned it a second time.

Licensing reminds staff that this document is taken with them in the case of an emergency and is used by emergency personnel to determine who is present.
Corrective Action(s): Ensure time of arrival and departure is recorded accurately and is reviewed throughout the day to ensure it's accuracy.

Comments

During inspection children were: engaged in yoga, playing outside in the rain, returning inside for free play which consisted of free art, circle time and then lunch.

During inspection Licensing observed staff persons getting down to child's level when interacting with them, giving warnings before transitions took place, and, assisting with problem solving when necessary.
