Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed:

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A staff person has a local Police Check, the manager stated that the Licensee hiring department changed conducting checks to the local Police and not the required Solicitor General (Victoria).
Corrective Action(s): Please ensure CRC are done through the Solicitor General

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Indication that reference checks have been completed is unavailable.
Corrective Action(s): Please ensure reference checks are available.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status for employee is unavailable
Corrective Action(s): Please ensure staff file is complete

STAFFING: 12130 - CCLR s.19(3) - Without limiting subsection (2), if the duties of an employee include care for a child who requires extra support, a licensee must ensure that the employee has the training and experience and demonstrates the skills necessary to care for that child.
Observation: Staff person does not show evidence of training, Manager stated compliance will be met end of next month.
Corrective Action(s): Please ensure staff have appropriate training.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The programs conduct separate fire drills, one of the group had conducted but not recorded one of the month.
Corrective Action(s): Please ensure monthly fire drills are recorded

Comments

Licensing provided the April 2019 Child Care Reporting Incidents Bulletin.
During today's inspection, discussion of level of resilient surface around an equipment in the I/T program was discussed.
Facility continues to provide opportunities for cultural enrichment.
Staff are provided with professional development opportunities.
Please provide written response to how the coded violations will be addressed by October 5, 2019
