Introduction

An unscheduled inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: Licensing noted there were no fire drills practiced since the facility opened.
Corrective Action(s): Please ensure fire drills are practiced monthly.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing noted there were no emergency supplies available for children in care.
Corrective Action(s): Please ensure supplies are available in order to respond to and recover from any emergency.

RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: Licensing noted there were no records of minor incidences available at the facility. At review, licensee confirmed minor incidences had occurred at the facility that were non-reportable. These were communicated to families, however were not documented.
Corrective Action(s): Please ensure a system is developed to ensure records of minor accidents, illnesses, and unexpected events not requiring medical attention are kept and maintained.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing reviewed 6 children's files and noted: 3 files were missing children's care card numbers, and 2 were missing immunization status.
Corrective Action(s): Please ensure children's files contain all required information, including MSP numbers and immunization status.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing noted there were no attendace records available for the children in care.
Corrective Action(s): Please ensure a daily attendace record is kept indicating for each day whether the chid is absent, or if the child is present, the time of arrival and departure.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Licensing reviewed 6 chidlren's files and noted: 1 file was missing a doctor's name, and 2 files were missing a doctor's phone number.
Corrective Action(s): Please ensure children's files contain all required information including the name and telephone number of a medical practitioner.

Comments

At this inspection dated November 14, 2019 there were 4 children and 1 staff present. At this inspection, the above noted contraventions were identified.

Licensing left the facility to complete the report off site - all contraventions were reviewed with the manager prior to writing the report. Licensing returned to the facility on December 4, 2019 to deliver the report and risk assessment.

Licensee discussed she was unaware of many sections of the regulations found to be in contravention today. Licensing spent additional time on site reviewing requirements, specifically: facility records, policies, emergency procedures and reportable incidences. Licensing also provided copies of the Reportable Incident Form. It is the responsibility of the licensee to know and adhere to regulation, including: the Child Care Licensing Regulation, the Community Care and Assisted Living Act, and the Director of Licensing Standards of Practice (Safe Play Space, Active Play and Family Child Care) and ensure understanding of requirements.

It is recommended that the licensee review the Child Care Links Checklist, as it provides a system of self-monitoring that would help meet requirements in each of the areas noted to be in contravention during the inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.
The licensee is to correct the contraventions by the dates provided and provide a written response to licensing by December 10, 2019 indicating the steps that have been taken to address the noted violations.
