Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). All areas of the facility were reviewed for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Staff working in the program who is also the appointed manager had an expired ECE certificate posted in the facility.
Corrective Action(s): Ensure all qualified staff have certificates posted.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: A kitchen in the facility which houses hazardous items did not have the door secured at the time of the inspection.
Corrective Action(s): Ensure children do not have access to objects or substances that may be hazardous to their health and safety.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11480 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: The program was playing outdoors at the time of the inspection. The away outdoor play area that has been previously approved was not being used as it is closed. An alternate away outdoor play area is being used without prior approval and a health and safety plan being created.
During today's inspection glass was discovered on the playground where the children were playing indicating ineffective safety checks or the space. Additionally off-leash dogs were in the park area which could pose an additional risk for the children.
The LO reviewed with the manager the requirement for an Away Play Space Health and Safety Plan to be submitted for approval.
Corrective Action(s): Ensure the health and safety or children in care is promoted at all times.

RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: The facility log book was not available for review during the inspection and the manager relayed that it has not been used in some time. The LO reviewed the requirement for log entries related to unexpected events on a regular basis.
Corrective Action(s): Ensure a record of minor accidents, illnesses and unexpected events is maintained on a regular basis.

RECORDS AND REPORTING: 19340 - CCLR s.59(c) - In respect of a record referred to in this Division, a licensee must (c) produce records, on demand, to the medical health officer.
Observation: The Manager working in the program was unable to locate her staff file during the inspection. This staff typically works at another location and confirmed to have a complete file but confirmed it was not available during the inspection.
Corrective Action(s): Ensure all records which includes staff files are available on demand.

Comments

On the inspection date of July 21, 2020 there were 6 children and 1 staff present. At this inspection the above noted contraventions were identified. Actions required by the licensee include a corrective action plan required to be submitted and actions required the LO include to review and monitor corrective action plan. As part of this Routine Inspection a Facility Risk Assessment Tool was completed. This inspection report and risk assessment was completed off site and emailed to the facility the same day.
