Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

Child Records and reporting

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: On review of the physical facility, Licensing observed that several areas were looking worn and paint was chipped and peeling in some areas. The toilets in the lower portion of the facility were stained and look unclean.
Corrective Action(s): Please ensure that all furniture and fixtures are in good repair and are clean when children are in attendance. Please provide a compliance plan as to how and when improvements will be made

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: On review of staff files, Licenisng observed that one staff on site today only had 1 character reference on file.
Corrective Action(s): Licensing recommends that 3 character references are obtained prior to employment.

STAFFING: 12080 - CCLR s.19(1)(e) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (e) a statement signed by a medical practitioner indicating that the person is physically and psychologically capable of working with children and carrying out assigned duties in a community care facility.
Observation: Licensing observed that a staff on site today did not have a medical statement signed by a medical practitioner in the staff file. Manager stated that this staff will be providing one as soon as possible.
Corrective Action(s): Please ensure staff documentation is complete prior to employment.

STAFFING: 12180 - CCLR s.22(2)(a) - A licensee must ensure that each employee (a) is trained in the implementation of the fire drill system and emergency plan described in subsection (1), including the use of any equipment noted in the fire drill system and emergency plan.
Observation (CORRECTED DURING INSPECTION): In discussion with 1 staff member, it was evident that orientation of fire drills and facility procedures had not been received prior to commencing employment. Discussed with Manager who stated that this is the first day of staff employment and staff will be orientated as the day progresses. Licensing observed some of that process once Manager had arrived at the facility.
Corrective Action(s): Please ensure that any new staff have an awareness of facility policies prior to commencing work.

STAFFING: 12430 - CCLR s.56(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: On review of staff files, Licensing observed that one staff had an expired criminal record check. Licensing stated that records need to be reviewed every 5 years.
Corrective Action(s): Please ensure all staff clearances are current.

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation (CORRECTED DURING INSPECTION): Licensing observed that there were 9 children in attendance in the Group Child Care < 30 month age program with 2 staff at the time of Licensing arrival. A third staff, currently exempted to work in place of an ECE Assistant arrived 10 minutes later, complying with staff to child ratio. In discussion with the Manager, this staff was not replacing an ECE Assistant - the third staff was working in the facilities school age program and is ECE certified. Manager arranged for staff to trade places, correcting the non-compliance.
Corrective Action(s): Please ensure that appropriately qualified staffing is in place with the correct staff to child ratio at all times.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: Licensing observed that the 2 group child care < 36 months of age programs were operating as one program. The licence clearly depicts 2 separate programs which must be operated as such. Licensing observed 9 children in attendance in one program that is licensed for 8 children. Supervisor stated that due to lower enrolment and staff schedules, once the attendance reaches 12, they move 4 children to the other group child care < 36 month program. This is a repeat contravention.
Corrective Action(s): Please ensure that both groups run independantly of one another and are staff appropriately with Infant/Toddler certified staff in each of the programs for the duration of operational hours. Licensing recommends considering changing this to 1 program of group child care < 36 months with a total capacity of 12 children to avoid this in the future and to assist with staffing.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was the Manager and 5 other staff
Staff to child ratio was in compliance with regulations in the group child care 30 months to school age program
Exemption is in place for an approved staffing schedule
Programming is posted and available for parent review and children's art work is displayed on the walls
Licensing observed Staff engaged with children during snack times in encouraged appropriate eating skills.
Licensing observed the children in free play with some TV and electronics time in the daycare program. This was followed by snack time and outdoor play.
Licensing observed staff singing with the children in the Infant/Toddler program while getting ready for snack. Healthy foods are encouraged and promoted.

Discussions with the Manager/:-
- Licensing reviewed hand washing protocols with the Manager.
- Licensing also discussed the operation of the upstairs Infant/Toddler program and gave recommendations (see violation section) to ensure that compliance is maintained at all times. This has been an issue in the past.
- Licensing provided information and resources regarding 'Live 5210'
* Please be aware of using fans during the Summer and ensuring the cords are secured to prevent tripping hazards.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection may be conducted at a later date to ensure compliance.
