Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Outdoor playground: various sizes of wooden planks and a heavy cement piece of gardening furniture were stored within the outdoor play space and accessible to the children; this poses a risk for potential fall.
Corrective Action(s): Ensure that a health and safe environment is provided at all times while children are in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: Washroom sink water temperature measured 60.2 degree celsius.
Corrective Action(s): Ensure that heated water accessible to children is no more than 49 degree celsius.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation (CORRECTED DURING INSPECTION): A record of the person's work history was not obtained for one staff member.
Corrective Action(s): Ensure all staff files are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation (CORRECTED DURING INSPECTION): Immunization status was not obtained for one staff member.
Corrective Action(s): Ensure that all staff files are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation (CORRECTED DURING INSPECTION): 2 staff's certificates on file were not validated by the ECE registry.
Corrective Action(s): Ensure all staff files are complete.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Fire extinguisher has not been serviced annually (expired in Apr 2023).
Corrective Action(s): Ensure that fire extinguisher is serviced annually.

Comments

At the inspection dated August 3, 2023 there were 3 children and 2 staff present. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer for review. As part of this Routine Inspection a Facility Risk Assessment Tool is completed. This inspection and the risk assessment were reviewed with the Manager onsite and the copy was emailed to the facility.

The following were discussed with the Manager:
- Bedding storage
- Napping equipment
- Temperature for the fridge, i.e. 0-4 degree celsius
- Outdoor playground log
- Naproom supervision
