Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Licensing observed that the name of the former Manager was posted in the facility
Corrective Action(s): Please ensure to post the name of the current Manager in the facility.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Licensing observed that a staff certificate was not posted in the facility.
Corrective Action(s): Please ensure all staff records are posted in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection Licensing observed the following in the outdoor play area of the facility:
-Stairs leading to the back porch had a small gate at the bottom of the stairs that was not affixed on either side. Large gaps were observed on both sides of the gate and children were climbing up and accessing the stairs. This is a repeat contravention from inspections #CLAN-CMYS7Y, #CLAN-CKZSTJ, #CLAN-C9VQEX, #CLAN-BURQAF
-Tricycles were observed. A steep drop near the entrance to the play area was observed. This is a repeat contravention from inspections #CLAN-CMYS7Y, #CLAN-CKZSTJ. Please provide active supervision in this area until this is corrected.
-A wooden ladder was leaning against the fence. This is a repeat contravention from inspections #CLAN-CMYS7Y, #CLAN-CKZSTJ, #CLAN-C9VQEX, #CLAN-BURQAF
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times to the children in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed several puncture marks in the floor mats. This is a repeat contravention from inspections #CLAN-CMYS7Y, #CLAN-CKZSJT, #CLAN-C9VQEX, #CLAN-BURQAF, #CLAN-C5UMZ9
In addition Licensing observed visible dirt and debris on floor mats in the sleep room.
Corrective Action(s): Please ensure the facility and equipment and fixtures and clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed four electrical outlet covers were exposed. This is a repeat contravention from inspections #CLAN-CMYS7Y, #CLAN-CKZSJT, #CLAN-C9VQEX, #CLAN-BURQAF, #CLAN-C5UMZ9
Corrective Action(s): Please ensure children do not have access to any objects or substances that may be hazardous to their health and safety.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: Licensing observed that the emergency evacuation drill was not practiced or recorded for the previous year.
Corrective Action(s): Please ensure the emergency evacuation drill is practiced and recorded once a year

CARE AND/OR SUPERVISION: 14220 - CCLR s.51(1)(a) - A licensee must (a) ensure that behavioural guidance is appropriate to the age and development of the child who is receiving the guidance.
Observation: Licensing observed the Manager use the following to guide children's behaviour:
-Holding firmly to a child's arm when the child was pulling away
-Verbally telling the children, "Whoever does not listen sits in the highchair" and physically walking towards the highchair to, "Bring the highchair to circle to show them".
-Verbally telling the children, "Whoever pulls the table sits in the highchair".

Licensing had a discussion with the Manager about inappropriate guidance strategies, reviewed the facility behavioural guidance policy, and provided education and modelling on age and developmentally appropriate strategies to guide children's behaviour. A resource on guiding children's behaviour will be sent to the Manager.
Corrective Action(s): Please ensure to provide behavioural guidance that is appropriate to the age and development of the child who is receiving the guidance.

PROGRAM: 18030 - CCLR s.44(1)(c) - A licensee must provide to children a comprehensive and coordinated program of indoor and outdoor activities that (c) complies with the program standards set out in Schedule G.
Observation: Licensing observed the toys, material and equipment in the indoor area and outdoor area of the facility. Insufficient toys and materials for a variety of age groups were observed. A school age child attends the facility and no materials were suitable for school age children. This is a repeat contravention from inspections #CLAN-CKZSTJ, #CLAN-C9VQEX, #CLAN-BURQAF, #CLAN-CBXSYK, #CLAN-C5UMZ9.
Corrective Action(s): Please ensure to provide sufficient toys and materials for all of the different ages of children that are registered in the program.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: One child's record was observed for two children. One child was missing their, gender, date of birth and immunization status. Another child's record was missing their MSP number
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing reviewed the attendance records. Several arrival and departure times were missing for the month.
Corrective Action(s): Please ensure the attendance records are complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: The children's records were reviewed. Two children's records were missing a medical practitioner and one record was missing an emergency contact. Records missing a medical practitioner is a repeat contravention from inspections #CLAN-CKZSJT, #CLAN-BURQAF

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: No care plan available for a child requiring extra support was observed. In addition another care plan was observed for a child but no name was listed at the top of the plan. No care plans for a child requiring extra support is a repeat contravention from inspections #CLAN-CKZSJT, #CLAN-CBXSYK, #CLAN-C9VQEX,
Corrective Action(s): Please ensure to have a current care plan for each child requiring extra support.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Licensing observed that two staff were working at the facility. Only one staff record was available for review at the time of the inspection.
Corrective Action(s): Please ensure staff records are on-site and available for review prior to the staff starting work at the facility.

Comments

At the inspection dated July 24, 2023 there were 3 children, 1 staff and the Manager was present. At this inspection the above noted contravention was identified. Please correct the above noted contravention by August 9, 2023, unless other wise specified in this report. Please submit a written response to Licensing by August 9, 2023 stating how you have corrected the above noted contraventions. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was provided to the Manager.
