Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DLP). Evidence for this report was based on the licensing Officers observations, review of the facility records and information provided by the facility staff at the time of inspection. All areas of the facility were inspected for compliance.
As part of the Routine Inspection a Facility Risk Assessment is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed that the emergency supplies is unusable - covered in a substance, damp and in need of replacement.
Corrective Action(s): Ensure supplies to respond to an emergency is in place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed that the back yard play space is unusable - fence is broken, debris, toys /space is in need of cleaning. Licensee stated that this space is not currently used and the neighbouring park is used.
Corrective Action(s): Ensure the outdoor playspace is available for children. Licensee stated that the play space at the facility will be ready for children's use April 30th, 2018. The licensee is required to submit an away play space plan.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: The licensee stated that the fire drills are practiced four times per year.
Corrective Action(s): Ensure fire drills are practiced monthly.

POLICIES AND PROCEDURES: 13100 - DLSOP Active Play - The Licensee must develop and implement an Active Play Policy to engage children in daily active play, consisting of un-facilitated play and facilitated games and activities.
Observation: The licensee stated that an active play policy has not been developed. The licensee stated that children go to the park on a daily basis, weather permitting.
Corrective Action(s): Ensure an Active Play Policy is developed and provided to families.

POLICIES AND PROCEDURES: 13120 - DLSOP Active Play - The Licensee must develop and implement a Screen Use Policy to guide employees in the use of screen time activities.
Observation: Upon arrival on the first day of this inspection, the main TV was on and the caregiver turned it off. On the second day of this inspection, the TV was on during the entire visit.
Corrective Action(s): Ensure a Screen Use Policy is developed and implemented.

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation: Upon arrival, licensing observed 1 child in the facility. When licensing asked if there were other children, the cargiver opened a door where two more children were seen. The two children continued to play in this room with the door closed during this short visit.
Corrective Action(s): Ensure children are continuously supervised at all times.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: Licensing observed that one children's records indicated a record that the licensee stated is no longer relevant.
Corrective Action(s): Ensure children's records are kept.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation (CORRECTED DURING INSPECTION): Upon arrival on the first day of this inspection, there were no children signed in. On the second day of this inspection, all children in attendance were signed in.
Corrective Action(s): Ensure arrival and departure times are recorded upon arrival and departure.

RECORDS AND REPORTING: 19340 - CCLR s.59(c) - In respect of a record referred to in this Division, a licensee must (c) produce records, on demand, to the medical health officer.
Observation: On the first day of this inspection, staff were unaware of where children's records were kept and not able to produce them. She did have parent contact info.
Corrective Action(s): Ensure records are available for staff.
