Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were reviewed for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: During inspection Licensing observed an area in the OOS outdoor playground where the resilient rubber tile has lifted. This is a concern both for a tripping hazard as well as compromising the resilient nature of the lifted rubber tile.

The Director of Licensing Standard of Practice "Safe Play Area" under Ground Surfacing" states the requirement for the depth of resilient surfacing required in the fall zone for the above ground play structure. Resilient surfacing reduces the risk of injury from falls. Therefore there must be nothing impeding this surfacing, for example tree roots which impede the resilient nature of the material being used. Should another resilient material be used in this area, the depth of the material being used would need to be no less than that noted under "Ground Surfacing" in this document in all areas that it is being used, ie: above the tree roots.

As the fall zone for the climbing wall is compromised by the raised rubber tiles, the Licensee will block access to this area from children.
Corrective Action(s): Ensure all tripping hazards are removed from the outdoor play area and that the resiliency of the tiles are not compromised by tree roots. Licensee to submit a plan to Licensing by September 30, 2019 outlining how this violation will be addressed.

Comments

At the inspection dated Aug. 1, 2019 there were 16 X < 36 months children; 17 X 3-5 children;15 X OOS children and 14 staff present. At this inspection the above noted contravention was identified.
Licensee to submit a plan, by September 30, 2019, to Licensing outlining how the uneven resilient surface area in the OOS outdoor play area will be remedied. In the meantime the Licensee will make the unsafe area of the outdoor playground inaccessible to children. Licensing will conduct a follow up inspection once the violation has been fully addressed.
As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
During inspection Licensing observed:
- infants engaged in free play as well as a circle time with movement
- toddlers having snack and a circle time and speaking to the Licensing Officer about their camping theme
- 3-5 children heading out on a field trip to a blueberry patch
- OOS children engaged in creating scrapbooks, melting bead creations, Lego as well as taking part in a Chess tournament.

- Staff in all programs were interacting with children while they were engaged in their activities, as well as assisting with problem solving when necessary.
