Introduction

All care categories were inspected during an unscheduled routine inspection to assess compliance w/:
• the Community Care & Assisted Living Act (CCALA)
• the Child Care Licensing Regulation (CCLR)
• relevant Director of Licensing Standards of Practices (DLSP)

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 3 employees' CRCs were applied for by their previous employer or school.
Corrective Action(s): Please apply to share these 3 employees' CRCs w/ the licensee @ https://www2.gov.bc.ca/gov/content/safety/crime-prevention/criminal-record-check/sharing-results.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: 2 employees lacked references in their file.
Corrective Action(s): ≥ 2 references must be obtained for each employee by their 1st day of employment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: 2 employees lacked their immunization status in their file.
Corrective Action(s): Employees' immunization status must be obtained by their 1st day of employment.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: There was no evidence that an employee's certificate had been validated.
Corrective Action(s): The licensee must verify all new employees' certificates before employment, as well as current employees' certificates upon each renewal. This can be done @ https://earlychildhoodeducator.gov.bc.ca/Public/CertAndRenewal/Certificate_Validation.aspx or by phoning 1.888.338.6622.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: 2 employees held an expired CRC.
Corrective Action(s): Please apply for these employees' new CRCs @ https://www2.gov.bc.ca/gov/content/safety/crime-prevention/criminal-record-check/online-service-information.

STAFFING: 12470 - CCLR s.60(4) - Immediately after a person who was the subject of a character reference is no longer employed by or ordinarily present at the community care facility, a licensee must return all character references to the person, or destroy the character references.
Observation (CORRECTED DURING INSPECTION): A former employee's references were still in her file.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The licensee explained that they practiced implementing the emergency plan last year; however, there was no evidence of this.
Corrective Action(s): Please document completion of the annual emergency plan practice upon completion.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: 3 children lacked their immunization status.
Corrective Action(s): All requirements of s. 57 must be obtained by children's 1st day of care.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: 5 children's start dates were written month & year.
Corrective Action(s): Complete starting dates must be documented (month, day, & year) for all children.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: A child lacked their medical practitioner's contact information.
Corrective Action(s): A walk-in clinic or hospital's contact information can be used if a child lacks a family Dr.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: A child's care plan lacked evidence that it was reviewed in the past year.
Corrective Action(s): Care plans must be updated annually w/ parents to review any changes, as confirmed by the parents' signature & date of review.

Comments

Summary of FIR #CGEE-C79NFY (24/Sep/2021)

11 violations were observed today, in which 1 violation was corrected during the inspection & corrective action for the remaining 10 violations includes:
• obtaining employee records
• documenting completion of each annual emergency plan practice
• obtaining children documentation

Licensees & employees play a key role in protecting children from, & minimizing the impact of infection & illness. CCFL discussed hand washing, cleaning, & physical distancing as per the BC Centre for Disease Control & the BC Ministry of Health's "COVID-19 Public Health Guidance for Child Care Settings" (http://www.bccdc.ca/Health-Info-Site/Documents/COVID_public_guidance/Guidance_Child_Care.pdf).

The inspection was reviewed w/ the licensee; however, this report & the Facility Risk Assessment Tool were written @ the Burnaby Health Protection office & emailed to the licensee on 27/Sep/2021.
