Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP).
All areas of the facility were reviewed for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Licensing observed that the Manager name was not posted at the facility.
Corrective Action(s): Please ensure this is visible to inform the public of who to contact as the need arises.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed a portable heater in the available play space which was hot to the touch and accessible to children. In discussion with the Licensee, the heater is supposed to be put away on opening to ensure children's safety. The staff on site was using the heater as the facility was a little cold.
Corrective Action(s): Please ensure a healthy and safe environment at all times when children are in care.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: On review of 3 staff files, Licensing observed that 2 staff do not have site specific clearances. Licensing acknowledges that the files do include a sharing of CRC application form dated for January 22nd and 26th respectively, but no evidence of completion.
Corrective Action(s): Please provide a health and safety plan to ensure there is no risk to children while awaiting a current clearance for these 2 staff.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: On review of 3 staff files, Licensing observed 1 file to be missing validation of certification from the ECE Registry.
Corrective Action(s): Please ensure all staffing files are complete at the time of employment

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: Licensing observed that the only staff on site today did not hold a current valid first aid certificate. Expiry date of previous certificate was December 2020. Staff stated that she was booked to complete firdst aid training on Saturday, February 27th. In discussion with the Licensee, she said that another first aid certified staff was available in the attached residential premise if assistance is required.
Corrective Action(s): Please ensure that children have immediate access to an employee with a valid first aid. Please provide evidence of compliance of staff certification upon completion.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: On review of the parent handbook at the facility, Licensing observed the following to be missing:
- Reportable Incident policy
- Abuse reporting policy
- Screen time policy
Licensing does acknolwedge that these policies were reviewed at application but need to be available for parent and staff review.
Corrective Action(s): Please ensure all policies and procedures are current and complete

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: Licensing observed that the only staff on site today was not appropriately qualified. Staff said that the ITE staff (the Manager) was currently working at another location but does come by to check on things.
Staff also said that she is scheduled to work the rest of the week along with another staff, who holds a responsible adult status, and who may occasionally work alone with the group.
For a group of 8 children under 36 months the only 2 staff on site should be ITE and ECE certified.
The Licensee contact said that one ITE staff was going to be working with the staff on site today but had to go to another location. She said that the RA staff never works alone but works as a support while the Manager does administrative work while on-site.
Corrective Action(s): At no time should a responsible adult be considered part of ratio for this service type as does not meet the requirements of Schedule E. Please ensure qualified staff are on site at all times and provide a staffing schedule to Licensing.

Comments

Summary of Inspection

At today’s inspection there were 2 children and 1 staff present. 6 children are currently enrolled.
Licensing reviewed the facility’s COVID-19 prevention strategies and noted the posting of the Covid-19 prevention plan.

At this inspection the above noted contraventions were identified.
Licensee is required to provide a corrective action plan to Licensing by the date below.
Licensing will review the plan and conduct a further follow up inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

The following education/recommendations were provided through discussion:
- Supporting of children with additional needs
- Staffing ratios and qualifications
- Parent handbook requirements
- Annual evacuation requirements
- Reportable Incident reporting to Duty line: #604 587 3936 for emergencies if area Licensing Officer can’t be contacted.

The facility has been receiving Licensing Officer’s emails.
