Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing observed that out of the three references obtained for the manager two were from the same person and were not validated
Corrective Action(s): Licensee will call and validate the references and make sure the third reference is obtained.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one or more employees.
Corrective Action(s): Licensee will ask the employee to complete the immunization status and include it in the staff file.

STAFFING: 12120 - CCLR s.19(2)(c) - A licensee must not employ a person in a community care facility unless the licensee is satisfied, based on the information available to the licensee under subsection (1) and the licensee's or, in the case of an employee who is not the manager, the manager's own observations on meeting the person, that the person (c) has the training and experience and demonstrates the skills necessary to carry out the duties assigned to the manager or employee.
Observation: Licensing observed that the manager was not aware of the following legislation:
-Care Plans and the purpose of the Care Plan
-Minor incident Log book- location and purpose
-Emergency Evacuation Supplies- Location
Medication Authorization form and permission from the parents
Corrective Action(s): Please ensure that the manager has the training and skills necessary to carry out duties delegated.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Out of three staff files reviewed one staff ECE certificate was not validated through the system maintained by the early childhood educator registry.
Corrective Action(s): Licensee validated the ECE certificate, printed the validation and included in the staff file during the inspection.

Comments

Summary of Inspection
At today’s inspection there were 3 children, manager, practicum student and licensee's son present.

At this inspection above noted contraventions were identified.
As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

The following was discussed
Attendance Record- recording each child separately in each row.
The lunch kits for the children in care are stored in the bags in the cubby area. It was discussed as weather warms up either to store lunch kits in the fridge or include ice pack.
Online Reportable Incident- has been able to create account.

The contents of this inspection report were reviewed with the facility manager but the report was written off site due to technical difficulties, therefore no signature was obtained. A copy of the report and risk assessment was later provided.
