Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: 2 of 5 employee files reviewed did not contain the verification of assistant or educator certificate.
Corrective Action(s): Ensure that each certificate is verified by the system established and maintained by the director of the early childhood educator registry.

POLICIES AND PROCEDURES: 13010 - CCLR s.22(1)(a) - A licensee must have all of the following: (a) emergency exits and a fire drill system approved by a local assistant within the meaning of the Fire Services Act.
Observation: The fire extinguisher was due for service in 2019.
Corrective Action(s): Ensure that the fire extinguisher is serviced annually according to the information on the service tag.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: At time of Licensing Officer arrival at lunch time there were 21 children with 2 employees. 1 employee was on a break and returned to the classroom at 12:45pm.
Corrective Action(s): Ensure that the employee to child ratio is no less than permitted in Schedule E.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: A child with a care plan for medication did not have the times specified or the amount required to be given to the child.
A child with a permission to administer medication form did not have the amount required to be given to the child.
Corrective Action(s): Ensure that the employees give medication according to the times specified and the amount required to be given.

Comments

Summary of Inspection
At the inspection dated March 9, 2021 there were 21 children and 2 staff present, a third staff arrived at 12:45pm. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
· Promoting Active Play in the program
· Care Plans
· Active Supervision
