Introduction

An unscheduled routine inspection was conducted today to assess compliance with the Community Care and Assisted Living Act, Child Care Licensing Regulationand the applicable Director of Licensing Standards of Practice. All areas of the facility were inspected for compliance except for the policies and procedures as there have not been any changes since the last routine inspection.

Contraventions
Previous Inspection - Contraventions observed on FIR #RDHI-B8Y2FF have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The Licensing Officer observed various outdoor equipment available for the children to use. There is a small slide (over 18" high) located on grass. The Director of Licensing Standards of Practice - Safe Play Spaces states "for equipment that is over 18" but is less than 5 ', protective surfacing is recommended. Ground covering, soil types, and climate are all factors which must be considered in making this decision. The intent of ground covering is to reduce the risk to a child should they fall from the equipment to the ground.

Corrective Action(s): The Licensee will need to review the ground surface and ensure that they are in compliance with the legislation and the manufacturer's requirements.

STAFFING: 12110 - CCLR s.19(2)(b) - A licensee must not employ a person in a community care facility unless the licensee is satisfied, based on the information available to the licensee under subsection (1) and the licensee's or, in the case of an employee who is not the manager, the manager's own observations on meeting the person, that the person (b) has the personality, ability and temperament necessary to manage or work with children.
Observation: the Licensing Officer reviewed 3 staff files and noted that they all have references however there is no evidence that the references have been verified.

Corrective Action(s): The Licensee will need to implement a system to demonstrate that they have checked/verified all references prior to a individual working with the children.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Upon review of three staff files the Licensing Officer noted that none of the files have evidence that the individual's early childhood educator's certificate has been verified.

Corrective Action(s): The Licensee and/or Manager will need to go to the ECE Registrar's website and verify each ECE certificate and keep a copy of the verification or implement another means to indicate that they have verified each certificate.

Comments

At the inspection dated December 3, 2019, there were 7 children with 2 staff present. At this inspection the above noted violations were identified and the actions required to be taken by the Licensee. As part of this routine inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The staff were inquiring about outdoor play and in particular the amount of time children need to be outdoor playing each day. The Licensing Officer provided the staff with a copy of the Director of Licensing Standard of Practice - Active Play as this document outlines the daily amount of time for outdoor play.

The Licensing Officer left with the staff a copy of the Director of Licensing Standards of Practice - Safe Play Spaces which addresses ground surface requirements for outdoor equipment.
