Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

The following areas were reviewed:

Care and supervision/Hygiene and medication
Nutrition
Program
Child Records and reporting

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Contraventions
Previous Inspection -
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: On arrival, Licensing was introduced to all the 7 children in care and Licensee commented on the child that had just left. In discussion, Licensee stated that attendance numbers were over the allowable capacity. 8 children were in attendance today. Licensee stated that Summer care is a little more erratic than usual.
Corrective Action(s): Please ensure that enrolment does not exceed the allowable capacity at any time.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed the children getting ready for snack time and observed that they didn't wash their hands prior to eating.
Corrective Action(s): Please ensure children are instructed in proper health and hygien practices particularly around hand washing.

NUTRITION AND FOOD SERVICES: 17100 - CCLR s.48(4)(c) - A licensee must ensure that children are not (c) left unsupervised while consuming food or drink.
Observation: Licensing observed the Licensee leave the children whilst eating, to answer the door to a parent. Licensee was away, out of sight of the children for nearly 2 minutes. There are 3 children 2 and under in care today. This is a concern that a could could choke whilst eating and Licensee would not be immediatley aware.
Corrective Action(s): Please ensure that children are always supervised while eating.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed that the attendance records were incomplete in that attendance had not been recorded for July 26th and July 27th 2017.
Corrective Action(s): Please ensure attendance records are accurate at all times.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was the Licensee with 7 children. on Licensing's arrival the children were involved in free play activities and then cleaned up for snack time.
Staff to child ratio was in compliance with regulations
Programming is posted and available for parent review on a notice board near the entrance. Licensee displays current information for parents.
Licensing observed Staff engaged with children during their free play activities. Language used was appropriate to the child/ren's age and stage of development.
Licensing observed the children cooperatively playing together and enjoying a variety of available equipment. Children enjoyed snack time which is provided by parents and supplemented by the Licensee.
The facility has a pet cat and a mouse that the children are accustomed to. Pet policy is in place.

Discussions with the Licensee:-
- Licensing reviewed available policies with the Licensee and discussed the requirements for Active Play and Screen Time policies to be available by September 2017.
- Licensing discussed effectively managing transition times to ensure safety of the children at all times.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection will be conducted due to the number and nature of the contraventions.
