Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation (CORRECTED DURING INSPECTION): Licensing observed that 4 staff certificates were not posted in the facility. Other staff certificates were posted for staff who no longer work at the facility and need to be removed. This is a repeat contravention
Corrective Action(s): Please ensure all current staff certificates are posted in the facility in the areas of which the staff work.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: On inspection of the physical facility, licensing observed the following:
- Paint is peeling off the wall in the Infant program space and children could pick this further and possibly put the pieces in their mouths which may be harmful.
- An electrical socket was uncovered in the Toddler room - children could poke items into it which may cause harm.
Corrective Action(s): Please ensure you provide a healthy and safe environment at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: Licensing observed a stroller placed at the bottom of the stairs next to the entrance/exit door. This stairwell is the access route as well as an evacuation route.
Corrective Action(s): Please ensure all access and exit points are kept clear at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed 2 spray bottles with bleach and water solution which were accessible to children in;
- The washroom, on top of the diaper change table
- The shelving unit in the Toddler program space which children can reach.
Both bottles were not labelled with their contents.
Corrective Action(s): Please ensure all hazardous substances are inaccessible to children

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Onb review of 6 staff files, Licensing observed that 1 was missing a resume. This is a repeat contravention
Corrective Action(s): Please ensure staff are appropriately screened prior to employment

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: On review of 6 staff files, Licensing observed 1 was missing immunization status. This is a repeat contravention
Corrective Action(s): Please ensure staff files are complete at the time of employment

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: On review of 6 staff files, Licensing observed 2 were missing validation from the ECE Registry

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: On review of 6 staff files, Licensing observed that 1 was missing a site specific criminal record check. Licesning notes that the clearance is current

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: On review of the attendance records during a random selection, Licensing observed:
- On Nov 10th 2017 there were 13 children signed in to the Toddler program
- On Nov 28th 2017 there were 13 children signed in to the Toddler program and 12 in the infant program
- On Dec 19th 2017 there were 14 children signed in the Toddler program and 12 in the infant program.
When a staff was asked if they ever have more than 12 children in the program, the answer was " sometimes but not really"
On discussion with the Director, it was stated that some children have stayed beyond their 3rd birthday (with an approved temporary placement) which caused over enrollment.
Licensing also observed during inspection that 2 other Toddlers arrived while the group of 12 were outdoors. This indicates that this practice is ongoing.
Corrective Action(s): Please ensure that you do not exceed the capacity of each group.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: On Licensings arrival it was observed that staffing qualification did not meet Licensing requirements of Schedule E.
- In the infant room there were 2 x ECE qualified staff and 1 x ECEA staff
- In the Toddler room there were 1 x ECE staff and 2 x ECEA staff
Although staff to child ratio was met, there was no ITE staff in either program. Licensing notes that the Director did arrive half an hour into the inspection - the Director holds ITE qualification.
It is also noted that the Director and Manager of the facility are aware of the ability to request a staffing exemption as have done so in the past to maintain compliance.
Corrective Action(s): Please ensure that staff have the required qualifications to meet the requirements of Schedule E of the child care licensing regulations.

CARE AND/OR SUPERVISION: 14360 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: Licensing observed that the facility was operating on occasion with a higher capacity than it is licensed for.
Director explained that some children wished to stay on past their 3rd birthday, by temporary placement approval but which then caused over capacity due to new enrollment.
On these occasions, children are at risk of not receiving adequate care and supervision to meet their individual needs as staff to child ratio exceeds regulations. There is also increased risk to the children should there be an emergency which requires evacuation. Exceeding capacity is also against fire approval
Corrective Action(s): Please ensure that the facility operates in a manner which promotes the health, safety and dignity of the children in care.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed that bedding for the children is stored in named cubbies of which 2 children share. Some of the cubbies had the bedding sitting on the shelf where others have a bag with bedding in as well as bedding on the shelf. The concern is that as the cubbies are shared, the bedding is not always seperated by being in individual bags to prevent cross contamination.
Corrective Action(s): Please ensure bedding for individual children remains seperated at all times.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: On review of attendanc e records, Licensing observed that on some occasions, children are not being signed out of the facility. As Director stated that children are often signed in on the wrong sheet, the attendance records are not always accurate as to where the children are. This is a repeat contravention

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: On review of 10 childern's files, Licensing observed 2 were missing digital images. This is a repeat contravention
Corrective Action(s): Please ensure all children's information is comlplete at the time of enrolment and prior to attendance

RECORDS AND REPORTING: 19188 - CCLR s.57(2.3) - Despite subsection (1), a licensee who provides a care program described as Child-minding must maintain at the community care facility the records referred to in subsections (2) to (2.2).
Observation: On review of a random selection of 10 children's files, Licensing observed that 1 child did not have any documentation on site. Director was able to show Licensing the registration forms on her cell phone through email. As the Director was not on site when this child arrived, staff had no information in place for the child and would not have been able to contact the parents/guardians in the event of an emergency.
Corrective Action(s): Please ensure that children's information is available to staff at all times when the child is in care

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was 6 staff with a total of 22 children as well as the Director.

Licensing observed the children in free play, snack time and outdoor play for the Toddlers - Director stated that the infants would go outside in the afternoon.
Facility provides all meals and offers a menu to the parents by email. Food permit is in place.

Discussions with the Director-
- Licensing reviewed the policies with the Director (see above)
- Licensing provided information regarding Appetite to Play and gave the immunization poster as a resource
- Licensing recommends ensuring an effective enrolment system is in place to avoid future over capacity issues.
- Licensing recommends having a wheeled container for the emergency supplies to ensure ease of transportation in an emergency. Evacuation drill should be practiced taking the supplies to the secondary location.

Licensing observed Staff engaged with children using appropriate guidance techniques.
A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection will be conducted due to the number and nature of the contraventions.

Report was written off site due to the lack of space at the facility.
