Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following on the premises:

- Inside the facility, the paint was peeling off the corners of the wall (small portions) at these locations: the wall near the classroom/playroom, the wall at the small hallway just before entering the bathroom, the wall in the nap room. Due to the paint peeling off, the drywall has been exposed.

- The soft material (that has been attached with a black tape) covering a short wall surrounding part of the outdoor play area has come off (near the steps), exposing the short wall made of rocks, and children can potentially injure themselves if they trip and fall.
Corrective Action(s): Ensure that the facility is always in good repair.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Although Licensing observed that one staff's Criminal Record Check (CRC) was completed with the Criminal Records Review board under a college's name, the CRC was not under the name of the childcare facility.
Corrective Action(s): Ensure all CRC's for staff are completed with the Criminal Records Review board under the name of the childcare facility.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation (CORRECTED DURING INSPECTION): At the beginning of the inspection, Licensing observed that one child's arrival time was not recorded on the attendance sheet. Towards the end of the inspection, Licensing discussed this matter with one of the staff.
Corrective Action(s): Ensure that when children arrive on-site, their time of arrival is documented on the attendance sheet.

Comments

At the inspection dated Dec. 13, 2023 there were 8 children and 2 staff present. The manager was not on-site during the inspection. At this inspection, the above noted contraventions were identified. Actions required by the licensee includes a written response. The contraventions noted in this report were reviewed with the facility during the inspection.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following recommendations/discussions were provided:
- Reportable Incident procedures which is to be reported within 24 hours. Child care staff are asked to call their Licensing Officer to make the report. If the Licensing Officer is unavailable, please call the Duty Line Licensing Officer.
- It was observed that the minor log bound book which a staff showed to Licensing during the inspection was blank. The staff said to Licensing that there has been no minor incidents that has occurred at the facility with children, and therefore the minor log bound book was blank. Licensing discussed what could be written and documented. Staff were reminded to take note of any illness and unexpected events involving children not requiring medical attention, and that are not reportable incidents as described in Schedule H and staff to initial and write the date after each documentation.
- Continue to clean and sanitize the facility including toys and equipment
