Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed four staff files. One file did not contain a site specific criminal record check for the staff member.
Corrective Action(s): Ensure all staff files are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed four staff files. One of these files did not contain evidence that the staff members early childhood educator certificate has been verified by the early childhood educator registry.
Corrective Action(s): Ensure all staff files are complete.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Licensing reviewed five active care plans. Three of these plans have not been reviewed with the parent within the past year.
Corrective Action(s): Ensure care plans are reviewed at least once each year with the parent.

Comments

At this inspection there were 45 children and 6 staff present. At this inspection the above noted contraventions were identified. The Manager is required to take corrective action to bring the facility in to compliance and provide a written response to Licensing by February 1, 2021. As part of this Routine Inspection a Facility Risk Assessment Tool will be completed and a copy will be provided.
The following education/recommendations were provided:
-COVID-19 prevention strategies; including seating arrangements for children to spread out for meals and activities, and the use of masks for staff when social distancing cannot be achieved.
-A review of documents/information to be posted in the facility.
-The facility uses an indoor gross motor space located on the main floor of the complex. This area is currently being used as both a play space by the child care facility and for building storage (boxes of open light bulbs, tables stacked on top of one another, etc). The staff stated that they supervise/guide children to ensure that they do not use the north side of the room used for storage. Licensing recommends further steps to be taken to ensure the storage portion of the room is not accessible to the children. Licensing will have a follow up conversation with the facility Manager.

The inspection findings were reviewed with the staff at the time of the inspection. The inspection report and facility risk assessment tool was written off site (.5 hours) and a copy of this report and the risk assessment will be emailed to the facility.
