Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP).
All care categories were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: On review of 4 staff files, Licensing observed that two were missing CRC's. Manager said that one new staff has completed the sharing results form and another staff CRC is probably on her phone. Staff are unable to work with children without a valid and current CRC in place.
Corrective Action(s): Please ensure all employee documents are obtained prior to working at the facility to ensure children's safety. Licensing will accept a health and safety plan to be provided by the Manager.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: On review of 4 staff files, Licensing observed that one staff did not have references on file and another only had 1 reference. Discussed further as to the requirement of references to be obtained prior to employment and more than one being required by legislation.
Corrective Action(s): Please ensure staff files are complete prior to working on site.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: On review of 4 staff files, Licensing observed that 1 staff file did not have certificate validation from the ECE Registry.
Corrective Action(s): Please ensure staff certification is verified prior to staff working with children.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: On review of three children's files in the GCC (30-sa) program, Licensing observed one file missing enrolment date,
Corrective Action(s): Please ensure accuracy of all children's files

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: On review of attendance records, Licensing observed that one child was transitioning to another program and had not been signed out of the first program. This was discussed to be a concern should there be an emergency for location of the child.
Corrective Action(s): Please ensure attendance records are accurate at all times.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: Care plan provided for a child did not contain a parent signature and on another care plan, it was not clear what action should be taken to support a child with additional needs. This was further discussed to ensure accurate information is available at all times to guide staff.
Corrective Action(s): Please ensure care plans are appropriately developed with parents to include all necessary information to guide staff.

Summary of Inspection

At today’s inspection there were 16 children within the two programs operating today, and 5 staff present.

At this inspection the above noted contraventions were identified.
The Licensee is required to address the contraventions to bring the facility back into compliance and provide a written response to Licensing by the date below.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

The following was discussed:
- Valid CRC/s are available for the majority (see violation section) and reviewed expiry dates.
- Active Play promotion
- Hygiene and sanitization practices and communicable disease plan in regards to food
- Program requirements to accommodate community needs
- Emergency evacuation plan and recording
- Licensing Duty line: #604 587 3936 for emergencies if area Licensing Officer can’t be contacted.
- Regular review of BCCDC website for COVID-19 updates (see link below)
