Introduction

An unscheduled follow up inspection to the Routine Inspection # SWAR-ATXNC9 dated November 7th 2017 was conducted. Areas of non-compliance identified at the Routine Inspection were reviewed and addressed at the follow up inspection dated December 11th 2017 for compliance.

Licensee/Manager had responded to the coded items in writing.

The following contravention was cited at the follow up inspection :
14030 - An exemption was put in place to bring facility into compliance, which has now expired and this staff no longer works at the facility

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12450 - CCLR s.60(3)(a) - A licensee must keep (a) in the case of employees, all records required under section 19 (1) [character and skill requirements] for the entire time that the subject of the records is an employee of the community care facility.
Observation: Licensing observed that there was no staff file on site for the second staff working at the facility today. Licensee stated that the records are not on site but will have them emailed to Licensing by the administrator. Licensing stressed the importance of always having staff files located on site as per the requirements of legislation.
Corrective Action(s): Please ensure a staff file is available for review at all times

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: In discussion with the Licensee it was determined that the second staff on site today did not hold the required certification as per Schedule E. Licensing was unable to verify the staff's credentials as no file on site. This is a repeat contravention and as Licensee is aware of the exemption application process, a request should have been made to have this staff plan approved prior to employment.
Corrective Action(s): Please ensure staffing meets the requirements of legislation

Comments

On site today was the Licensee and another staff member with 7 children in attendance.
In discussion with the licensee, this staff has an expired ECE certificate and therefore only meets the requirements of an RA.

Licensing observed the children in a circle time prior to beginning their Montessori cycle.
The staff was engaging the children in songs, stories, movement using instruments. Licensing observed appropriate guidance techniques in place.
