Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #DCAR-A44RNE have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11080 - CCLR s.15(1)(a) - A licensee must supply equipment, furniture and supplies that are (a) of sturdy and safe construction, easy to clean and free from hazards.
Observation: Padded vinyl foam climbing squares were observed to be cracked / torn with exposed foam , some sections were duct taped in an attempt to repair. An area rug ( 103 ) and carpeted area ( 104 ) consisted of frayed edges and presented a tripping hazard.
Corrective Action(s): please ensure equipment and furnishings are in good repair and free from hazards to reduce risk of injury

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: drying rack located in the cubby area blocking emergency exit
Corrective Action(s): please ensure furniture is located so as not to hamper an exit to ensure safe evacuation.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11120 - CCLR s.15(2)(c) - A licensee must ensure that each piece of furniture or equipment for sleeping (c) is appropriate for the size, age and development of the children intended to use it.
Observation: current practice is for those children requiring nap to sleep within their provided strollers. discussed safety concerns related to this practice.
Corrective Action(s): please ensure children are provided with clean and comfortable sleeping arrangements which is appropriate for their age and development.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: concrete stairs leading into the play area is accessible to children , past practice is for staff to actively supervise to ensure children do not access the stairs , discussed examples where it may not be possible for staff to remain in front of the stairs when children are playing elsewhere within the yard.
Corrective Action(s): please ensure children do not have access to the stairs while playing within the yard in order to reduce risk of injury.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): cleaning solutions stored within the nap area in an unlatched cabinet under the sink , an exposed electrical outlet was observed on the lower wall accessible to children.
Corrective Action(s): The staff secured the cabinet and covered the outlet during the inspection.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: Hot water at sink accessed by children measured at 52.9 Celsius , it was further noted that the sink was located within the nap area which was not the sink identified to be used as part of this program. Staff provided supervision to the area / assisting children adding that cold water would be added.
Corrective Action(s): Please ensure children do not have access to heated water which exceeds 49.Celsius tp reduce risk of scalding.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: records support that fire drills were held for 3 months of the year only in one program and missing for March and June within the other program. Staff included that the programs practice fire drills separately of each other.
Corrective Action(s): please ensure fire drills are held and recorded monthly , it is appropriate to practice together as an entire group should you choose to implement this practice.

RECORDS AND REPORTING: 19050 - CCLR s.56(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: a log book containing entries was in place for 2015 , no entries had been made in 2016 ( past 12 months ) based on shared details it is evident that non reportable / minor incidents have occurred yet have not been documented.
Corrective Action(s): please ensure a log of minor accidents , illnesses and unexpected events are documented.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Times of arrival and departure were not recorded but rather a check was in place to indicate if a child was in care , 1 child arrived 1 hour after class began and an x was inserted within the attendance form. Staff included this to mean that a child was not in care but as observed that child was on site but had arrived late.
Corrective Action(s): please ensure attendance records reflect times of arrival and departure and whether a child is absent. Discussed with staff that they may complete this record on the parents behalf.

RECORDS AND REPORTING: 19181 - CCLR s.57(2.1)(a) - Despite subsection (2)(a) and (d), a licensee who provides a care program described as Child-minding must do all of the following: (a) if applicable, record that a child does not have a medical insurance plan number or medical practioner.
Observation: 6 children's registration files audited 1 included that a medical practitioner and medical insurance plan number could not be obtained the remaining 5 files did not included any information relating to medical plan or Dr information.
Corrective Action(s): please ensure it is recorded if a child does not have a medical insurance plan number or medical practitioner.

Comments

Program currently operates Monday - Thursdays 9:00 - 1:00 however may develop additional programs which meet the definition of Childminding on Fridays.
Contract to be provided to Licensing in April 2017 when reflective changes are in place.
Observed children engaged in story time , snack , free play activities. Outdoor time did not occur today due to extreme cold weather conditions.
Additional time spent on site with program manager in discussion of new requirements Active Play , Screen Time Policy and in review of 5210 resources.
Licensing to confirm correct email address as the LINCS program has not received updates from the CCFL Office.
Thank you for your time during todays inspection , as the programs will be closed over the holidays written response extended to January 2017. .
