Introduction

An unscheduled follow up inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: An Early childhood educator assistant certificate was not posted.
Corrective Action(s): Ensure that all educator and assistant certificates are posted.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The following was observed:
- Broken fence and gate in the 3-5 playground with sharp nails exposed. Corrected on second day of inspection.
-Infant Toddler playhouse door was broken and propped against the playhouse.
-Morning Glory was present on the Infant toddler and 3-5 playgrounds. The plant seeds are poisonous to children.
Corrective Action(s): Ensure that a healthy and safe environment is provided at all times while children are in care.
- Please provide a plan of how you will ensure children are not in contact with morning glory when outside.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Employees are not scheduled to work according to Schedule E. An ECEA was working as the second employee in the Group Child Care (under 36 months) program.
Corrective Action(s): Ensure that employees to children ratio is no less than schedule E.

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation: The Group Child Care (30 months - School age) program was left unsupervised.
Corrective Action(s): Ensure that the children are supervised at all times.

HYGIENE AND COMMUNICABLE DISEASE: 15010 - CCLR s.14(4)(a) - A licensee, other than a licensee who provides a care program described as either Preschool (30 Months to School Age) or Group Child Care (School Age), must have in a community care facility a sturdy surface for changing diapers, located outside the food preparation area, next to (a) a covered container for soiled clothing.
Observation: the garbage can next to the diaper change area that was used for soiled diapers did not have a lid.
Corrective Action(s): Ensure that the garbage can next to the diaper change area used for diapers is covered.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: It was observed that staff and children did not wash their hands after diaper changing.
Corrective Action(s): Ensure that staff and children was hands after each diaper change.

MEDICATION: 16030 - CCLR s.53(2)(a) - A licensee must ensure that a child's medication is not accessible to any child, except that a child may have access to his or her own medication if (a) the child's parent has instructed the licensee to permit this.
Observation: Medication was accessible to children in care.
Corrective Action(s): Ensure that medication is not accessible to children in care

MEDICATION: 16050 - CCLR s.53(3)(a) - A licensee must ensure that at all times an employee is available who is competent to either (a) administer a child's medication as instructed by the child's parent or required by the child's record or care plan.
Observation: No employees were aware of the care plans or medications required.
Corrective Action(s): Ensure that there is an employee who is competent to administer the child's medication as instructed by the parent or the care plan.

Summary of Inspection
At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response.
