Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: A teeter toter is missing the foot placement , storage shelf at entrance to the yard is unstable ( easily moves when touched )
the shed door is stuck ajar and does not fully close which does not prevent access to items stored within.
Indoors - a toy bin consists of a cracked lid and children's fabric chair is stained.
Corrective Action(s): please ensure indoor and outdoor play equipment and materials are in good repair , clean , and safely constructed.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Items stored within a shower in a washroom accessed by children include spray bottle , products , razors.
Corrective Action(s): please ensure children do not have access to any item or substance that may be hazardous to their health and safety.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation (CORRECTED DURING INSPECTION): Hot water at sink accessed by children records at 55.9 degrees Celsius The hot water was turned off during the inspection.
Corrective Action(s): please ensure children do not have access to heated water which exceeds 49 in order to prevent risk of scalding.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: 1 staff file missing references.
Corrective Action(s): please ensure systems are developed to review staff files for completeness

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Resume missing for both substitute staff files
Corrective Action(s): please develop a system to ensure staff files are complete with required documentation

POLICIES AND PROCEDURES: 13100 - DLSOP Active Play - The Licensee must develop and implement an Active Play Policy to engage children in daily active play, consisting of un-facilitated play and facilitated games and activities.
Observation: Active Play Policy has not been developed or provided to families , Licensee stated she was unaware of this requirement.
Corrective Action(s): please ensure as specified in the Director of Licensing Standard of Practice ( DOLSOP ) that Active Play Policy is developed , implemented and provided to families.

POLICIES AND PROCEDURES: 13120 - DLSOP Active Play - The Licensee must develop and implement a Screen Use Policy to guide employees in the use of screen time activities.
Observation: Screen Time Policy is not included with the center's policies. Discussed the requirement as specified in the DOLSOP Screen Time Policy. Resources have been provided electronically and are available on the FH website to assist you/
Corrective Action(s): please ensure Screen Time policy is developed , implemented and provided to families.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Children seated to have lunch , table was not cleaned prior. Single use hand towel at the sink in use by children , paper towels in place however not used. diaper disposed of in an exposed garbage can in the washroom.
Corrective Action(s): please ensure systems are in place which establishes health and hygiene practices

NUTRITION AND FOOD SERVICES: 17100 - CCLR s.48(4)(c) - A licensee must ensure that children are not (c) left unsupervised while consuming food or drink.
Observation: Licensee entered the washroom area to assist a child while other children were seated and eating lunch. 2 children were also observed to be in highchairs and were not secured with the attached safety straps during this time. Discussed this high risk practice as a result of lack of supervision at meal times and when inappropriately secured.
Corrective Action(s): please ensure children are supervised at all times while eating and when placed in highchairs to avoid risk of injury..

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2),
(b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and
(c) the consents referred to in subsection (3).
Observation: Registration forms and care plan / information in place for one child which is many years old, the child information has changed and is not longer current.
Corrective Action(s): please ensure records are current to accurately reflect children's information and details instructing staff in their care.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Children's registration forms do not contain a field to include start date at the facility. Discussed updating registration forms to ensure all relevant information is captured.
Corrective Action(s): please ensure children's records include date of enrolment.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Care plan in place requires to be reviewed and updated , noted changes in the prescribed medication and procedures as outlined in the original plan.
Corrective Action(s): please ensure care plans are current , reviewed annually and updated as required.

Comments

Discussed updating registration forms , LO to forward a copy of the FH forms for your consideration.
Indoor and outdoor areas consist of an excessive amount of toys and equipment , discussed decreasing the amount to allow more space ( indoors ) and more space within the yard.
Licensee and her spouse completed first aid training together , only one copy of the certificate could be printed. Licensee demonstrated completion by producing an electronic copy on her phone and states that attempts to secure the missing copy ( spouse ) will continue.
Observed children participating in free play, art activities , outdoor time.
Written response dated extended as arranged due to upcoming event.
