Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP).

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation (CORRECTED DURING INSPECTION): Manager's name was not posted onsite.
Corrective Action(s): Ensure the name of the manager is posted in a prominent place within the facility.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Criminal Record Check not obtained for 1 staff.
Corrective Action(s): Ensure all staff files are complete.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation (CORRECTED DURING INSPECTION): 4 staff files were reviewed; minimum of two character references were not obtained for 1 staff.
Corrective Action(s): Ensure all staff files are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation (CORRECTED DURING INSPECTION): 4 staff files were reviewed; 2 staff were missing their immunization record status,
Corrective Action(s): Ensure all children's files are complete.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Preschool - Staff to Child ratio not maintained. (ECE/ASST)
Corrective Action(s): Ensure staff to child ratio is maintained as per Sch. E of CCLR.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: 15 children's files were reviewed; 3 children's date of enrolment were missing.
Corrective Action(s): Ensure all children's files are complete.

Comments

Summary of Inspection
At today’s inspection there were 16 children and 4 staff present. At this inspection the above noted contraventions were identified. Licensee is required to provide a written response by below date, including how areas found to be in non-compliance are addressed. As part of this Routine Inspection, a Facility Risk Assessment Tool was completed. This report was reviewed with the Manager and a copy was provided.
LO observed and discussed the following with Manager /staff on site:
- Reference letters within staff's file: to conduct reference check and document indicating that character references were obtained in respect of the person by the licensee or manager as part of the hiring process
- Medication storage: any life saving/ time sensitive medication should not be locked in a box
- Emergency drills : to practice with all children in care, including with part-time or drop in children
- Emergency supplies: to develop a system to regularly monitor the supplies and its expiry dates
- Exemption application ( staffing)
