Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION): Licensing observed a blind cord dangling in Room 1 and a large 'dip' in the infant/toddler playground from the removal of a tree stump. There was also standing water in a plant pot in the same area.
Corrective Action(s): Manager corrected both of these observations by hanging the blind cord and placing a piece of play equipment over the 'dip' until it can be permanently rectified. The water has been tipped out and staff indicate that a check is completed prior to going outdoors.

STAFFING: 12010 - CCALA s.7(1)(d) - A licensee must do all of the following: (d) appoint a manager for the community care facility.
Observation: Current Manager is new to the facility and Licensing did not receive confirmation of the new appointment. This Manager has been in place since the beginning of the school year (September). A change in Manager must be notified to Licensing after 30 days. Licensee was under the impression that the application to change Manager had been submitted by the previous Manager.
Corrective Action(s): Licensee has given Licensing the original documentation to complete the process Licensing also requires a Licensee declaration and Manager job description. (to be emailed to Licensee by Licensing on return to office)

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: On review of 4 staff files, Licensing observed that 1 staff did not have a current cleared criminal record check on file. There was a note on the file to say that it had been sent for in August 2016
Corrective Action(s): This staff must not work at the facility until a cleared criminal record check is on file
Date to be Corrected: October 12th 2016

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed 4 staff files and observed that one staff only had 1 reference check on file
Corrective Action(s): Please ensure that there are at least 2 character references on file for each staff member.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: On review of 4 staff files, Licensing observed that 2 staff were missing immunization status
Corrective Action(s): Please ensure staff files are complete at the time of hire.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation (CORRECTED DURING INSPECTION): Licensing observed a curtain hanging in Room 2 bathroom that was above a toilet and accessible to the reach of children. This is a concerns for cross contamination of germs.
Corrective Action(s): Manager tucked the curtain up to make it inaccessible to children and will input a more permanent solution

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: On review of a random selection of 10 child files, Licensing observed one was missing the child's sex.
Corrective Action(s): Please ensure all documentation is correct at time of registration
Date to be Corrected: October 21st 2016

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: On review of a random selection of 10 child files, Licenisng observed that one was missing the name and number of a Doctor.
Corrective Action(s): Please ensure this information is obtained in case of an emergency situation.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was the new Manager, 7 staff and the Licensee arrived during the inspection.
Staff to child ratio was in compliance with regulations
An exemptions is in place, details are on the Licence.
Programming is posted and available for parent review
Licensing observed Staff engaged with children using a respectful tone and offering appropriate guidance to meet children's individual needs. Licensing observed the children engaged in Montessori activities through freedom of choice. A variety of equipment is available that meets the requirements of Schedule G.

Discussions with the Manager/Licensee:-
- Licensing reviewed the program requirements and expectations of each available program room and for clarity, assisted the Manager with measuring Room 1 and 2. Also discussed attendance record clarification for each program room.
- Licensing provided and discussed information regarding the additions in legislation
- Discussed the notification of the new Manager as not being received by Licensing - Licensee provided Licensing with the original copy to process.
- Licensee has input a security system which involves surveillance cameras and access security. Parents are made aware on enrolment.
- Licensing recommends conducting a full evacuation drill to the secondary location with all the emergency supplies. Provisions are kept outdoors in the shed. Please ensure this drill is recorded once practiced.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection will be conducted to observe the Group Child Care School Age program.
