Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

The following areas were reviewed:

Staffing
Policies and Procedures
Care and supervision/Hygiene and medication
Nutrition
Program
Child Records and reporting

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Two staff files were reviewed and a Criminal Record Check (CRC) is missing for one staff who works as a substitute staff.
Corrective Action(s): As discussed, please ensure a CRC is obtained for all staff prior to employment, and that this staff does not work alone until a CRC has been obtained. The Manager stated she is aware the staff does have a CRC as she works at another centre, thus Manager made aware of process for requesting this result to be shared to ensure a site specific result is on file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Review of staff records indicated validation of ECE Certificate is missing for one staff.
Corrective Action(s): As per requirements, please ensure all staff documentation is complete prior to employment.
Date to be Corrected: March 1,2019

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: Fire drill record indicates a drill was not conducted for the months of November and December 2018.
Corrective Action(s): Please ensure the fire drill is conducted every month as per requirements. Please note this is a repeat violation.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Thirteen emergency consents were reviewed and all were complete with the exception of missing photos and/or digital images for 4 children. Records indicated the photos have been requested from parents.
Corrective Action(s): Please ensure all records are complete for children prior to attendance. Manager made aware digital image is also acceptable for the records.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

The Manager and one staff were on site today with 9 children in care.

Discussions regarding the following took place with the Manager:

Temporary Placements
Active supervision
Lead in water
Reportable Incidents

At present there are no exemptions/temporary placements in place

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection may be conducted due to the number and nature of the contraventions.
