Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: During the inspection it was observed that two staff certificates were not posted. This is a repeat contravention from inspection
# CLAN-BJ5PNW.
Corrective Action(s): Please ensure staff certificates are posted in a prominant place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: -Licensing observed the following inside the facility:
A full piano keyboard was placed on top of a smaller shelf.This could be a potential falling hazard. The piano keyboard was removed during the inspection. This is a repeat contravention from inspection # CLAN-BJ5PNW
-A toilet brush and a pluger were accessible to the children 0-36 months of age. The toilet brush is a repeat contravention from in spection # CLAN-BJ5PNW.
-stacked boxes of photocopy paper were observed in the hallway. This could present a falling hazard.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times to the children in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11080 - CCLR s.15(1)(a) - A licensee must supply equipment, furniture and supplies that are (a) of sturdy and safe construction, easy to clean and free from hazards.
Observation: Licensing observed that a small table was not sturdy and had marks in it that may harbour bacteria. In addition a portion of the counter in the washroom was splitting.
Corrective Action(s): Please ensure the equipment and furniture are sturdy and safe.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11170 - CCLR s.16(3)(b) - A licensee must ensure that the entire outdoor play area is (b) constructed in a manner, and using materials, that are suitable for the age and development of the children intended to use it.
Observation: Licensing observed that the landscape fabric in one of the playgrounds was exposed. This could present a potential tripping hazard. This is a repeat contravention from inspections # KSEY-B8JRK61 and # CLAN-BJ5PNW.
Corrective Action(s): Please ensure the playground is constructed in a manner that is free from hazards

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following inside the facility:
-Many bleach bottles were within easy reach of the children. This could present a possible poisoning or blinding hazard. This is a repeat contravention from inspection #CLAN-BJ5PNW
-A bottle of disinfectant spray was on the counter at the children's level. This could present a possible poisoning or blinding hazard. This is a repeat contravention from inspection #CLAN-BJ5PNW
-Two cupboards with bleach under the sink were left unlocked. A safety lock was present but it was not fastened.
-In some of the classrooms staff bags and purses were easily accessible to children. This could present many potential hazards. This is a repeat contravention from inspection #CLAN-BJ5PNW
-Rust was observed on two toilet fixtures in the washrroms. This could present a possible health hazard.
This is a repeat contravention from inspection #CLAN-BJ5PNW
-Several electrical outlets were exposed. This is a repeat contravention from inspection #CLAN-BJ5PNW
-Several cords and a stereo were not secured. This could present a potential strangulation hazard. This is a repeat contravention from inspection #CLAN-BJ5PNW
-Several classrooms contained open garbage containers with rubber gloves and paper towels. Due to the COVID-19 pandemic this could present a potential hazard.
- An epipen was observed in the 0-36 month cubby area in a clear plastic bag. This could cause a serious hazard to the children's health and safety. This was corrected during the inspection.

The following was observed in the outside play area:

-Rust on two bolts in the play area and rust on fixtures on the stairs leading to the outdoor play area. This could present a possible health hazard.
Corrective Action(s): Please ensure children do not have access to any objects or substances that are hazardous to their health and safety

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: During the inspection the record of fire drills was observed. No fire drill was practiced or recorded for the month of August. This is a
repeat contravention from inspection #CLAN-BJ5PNW.
Corrective Action(s): Please ensure fire drills are practiced at least once a month.

PROGRAM: 18060 - CCLR s.44(3)(4)(5) - A licensee, other than a licensee providing a care program described as Occasional Child Care, must provide each child with daily outdoor play periods unless weather conditions would make it unreasonable to do so. (4) Despite subsection (1), a licensee who provides a care program described as Occasional Child Care need not provide a program of outdoor activities. (5) Despite subsection (3), that subsection applies to a licensee who provides a care program described as Child-minding only if the program provides care for 3.5 hours or more each day.
Observation: During the inspection licensing discussed the frequency of outdoor play with the staff in each classroom. In discussion with the staff they stated that the children do not participate in outdoor play time when it is raining.
Corrective Action(s): Please ensure children have daily outdoor play.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing observed 9 children's records. Two records were missing a child's gender and two records were missing a child's MSP number.
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Licensing observed nine children's records. Four children's record were missing a doctor's name and number. This is a repeat contravention from inspection # KSEY-B8JRK6 and # CLAN-BJ5PNW. Two children's records were missing an emergency contact other than a parent. This is a repeat contravention from inspection # CLAN-BJ5PNW.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Licensing observed nine children's files. Three children's records were missing a photo.
Corrective Action(s): Please ensure the children's records are complete.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: Licensing reviewed nine children's records. Four children's records were missing written consent to contact a medical practitioner or ambulance in case of emergency.
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: During the inspection licensing observed emergency medication for one of the children in a classroom. There was no information or instructions recorded in a care plan that gave direction on when the medication was needed or how it was to be administered. The serious risk to health to safety of the child in care was discussed.
Corrective Action(s): Please ensure a care plan is created that provides instructions on how and when to administer emergency medication.

Comments

At the inspection dated September 23, 2020 and September 25, 2020 there were 86 children and 17 staff and one Manager present during the second inspection date. At this inspection the above noted contraventions were identified. Please ensure a written response is submitted to licensing by October 16, 2020 stating how you have addressed the above noted contraventions. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Manager.

The following was reviewed/discussed with the staff and the Manager:

· Information sent out to the facility regarding the following: sanitization/disinfection, social distancing, hand washing and health and wellness policy.
· The coronavirus COVID-19 public health guidance for child care settings
· Creating and posting a COVID-19 policy, as a requirement of The Centre for Disease Control and Worksafe BC

In addition the Manager and the Licensing officer discussed the importance of creating a system to organize and maintain the children's records and emergency cards.

The inspection findings were reviewed with the Manager at the inspection. The inspection report and the risk assessment were completed at the Burnaby Health Protection office. The report was written in 1 hour and this is included in the report. A copy of these documents were sent to the Manager.
