Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: On review of 6 staff records, licensing observed 1 was nissing a character reference (only 1 reference on file)
Corrective Action(s): Plese ensure all staff documentation is in place as per Section 19 of the CCLR's

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: On review of 6 staff files, Licensing observed that 1 was missing a resume. This is not a critical violation
Corrective Action(s): Please ensure all staff files are complete prior to hiring.

STAFFING: 12150 - CCLR s.19(4)(b) - A licensee must not employ a person in a community care facility as (b) a responsible adult unless the person has the qualifications required under Division 2 [Employee Qualifications].
Observation: On review of 6 staff files, Licensing observed a staff working as a responsible adult, without responsible adult certification/status. The facility did have a staffing exemption in place to accommodate this which expired on August 6th 2018. Staff stated that they are still working on it.
Corrective Action(s): Please ensure all staff meet the requirements of Schedule E

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: Licensing observed that upon arrival the Group Child Care (school age) program was being supervised by 1 staff that did not have responsible adult status. The second staff arrived at 9.30am.
Corrective Action(s): Please ensure children are appropriately supervised by qualified staff at all times.

RECORDS AND REPORTING: 19052 - CCLR s.56.1(2)(b) - A Licensee must keep (b) a current record of each person to whom the written agreement is delivered in accordance with that section [CCALA s.19]
Observation: On review of a random selection of 14 children's files and observed that 2 were missing the signed repayment agreement
Corrective Action(s): Please ensure that this record is kept for all children's files when delivered to families.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: On review of a random selection of 14 children's files, Licensing observed that 1 was missing immunization status and 2 were missing medical insurance numbers.
Corrective Action(s): Please ensure all children's information is complete at the time of registration.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: On review of a random selection of 14 children's files, licensing observed that 2 were missing enrolment dates.
Corrective Action(s): Please ensure all children's files are complete at the time of registration.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: On review of attendance records Licensing observed the following:
- Some records did not have pick up times (GCC school age)
- Children were moved from original sign in room to another program room without signing out (GCC school age)
- Some records did not show when the child was absent when expected for the day (GCC school age)
- GCC (30-sa) did not sign out of the program room when attending the gym
Corrective Action(s): Please ensure accurate attendance is in place for all programs particularly in an emergency situation.

RECORDS AND REPORTING: 19200 - CCLR s.57(3)(b) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (b) to release a child to someone other than the parent.
Observation: On review of a random selection of 14 children's files, Licenisng observed that 1 was missing alternate contact/pick up information.
Corrective Action(s): Please ensure that all children's information is complete at the time of attendance.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: On review of all care plans in place, licensing observed that 4 were requiring annual review.
Licensing notes that all care plans were complete with relevant information that would appropriately inform staff as to care requirements. This is a repeat contravention during other routine inspections.
Corrective Action(s): Please ensure all care plans are updated on an annual basis and that that informationis provided to all programs holding that information.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above
Licensing was on site with a practicum student from the JIBC
On site today was 7 staff. Manager was away.

Staff to child ratio was in compliance with regulations apart from above.
Programming is posted and available for parent review - children's art work is displayed.
Licensing observed the children in free play activities and snack time as well as gym time and circle activity.

Discussions with the Staff:-
- Licensing reviewed attendance reporting with the Staff
- Licensing provided information regarding Appetite to Play (see above website)
- Licensing recommends an audit of children's and staff files to ensure accuracy.
- Discussion on active supervision and following facility policies.
- Discussion Re: Lead in drinking water – a reminder to flush pipes if building older than 30 years (this building is a new build school)
- Discussion Re: Reportable Incident reporting to Duty line: #604 587 3936 if area LO not available.
- Bill 5:
There was an exemption in place for an extra child in the school age program which has now expired. Please provide an amendment application to return to the original capacity. Should you require this extra spot, a referral to the Township will be required.
Licensing observed Staff engaged with children during their activities and noted respectful language and appropriate guidance techniques in place.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection may be conducted due to the number and nature of the contraventions.
