Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection licensing observed that the windows in the play area were left unlocked. A lock was present but not applied. This could present a potential falling hazard.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: Licensing observed that both the outdoor playground gates were locked with bungy cords while the children were playing in the outdoor play area. In discussion with the staff she stated that the children open the gates. We discussed active supervision and purchasing a lock that is accessible to staff but not children.
Corrective Action(s): Please ensure an emergency exit is not blocked to ensure a safe exit in a potential emergency.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following inside the facility:
-Plant food chemical was accessible to the children
-Disinfectant spray in he washroom was located at the children's level
-two chairs in the kitchen were placed in the corner and abutted two intersecting windows. The windows were open greater than four inches wide and no screens, locks or limiters were applied. This is a serious health and safety risk to the children in care as these windows are located on the second floor. Licensing strongly recommended reducing the window openings to under 4 feet and applying window limiters and locks when windows are open. Having windows at the childrens level that were not securely locked is a repeat contravention from inspection # CLAN-BFENMC

Licensing observed the following outside the facility
-A metal bench was located right next to and underneath the climbing structure. The bench could create a hazard as a six foot distance is required around the climber.
-A metal bench had rust in several spots. This could present a potential health hazard.
Corrective Action(s): Please ensure children do not have access to any objects or substances that are harmful to the children's health and safety.

STAFFING: 12370 - CCLR s.37(3)(b) - Despite the employee qualifications required by Column 4 of the table in section 1 of Schedule E [group sizes and employee to children ratios], a licensee must replace an absent employee described in Column 1 of the following table who is absent (b) for 30 consecutive days or more with a person described in Column 3 opposite that employee and the row in Column 2 labelled as "≥ 30 days".
Observation: Licensing observed that the Manager is no longer working at the facility. Another Manager's name was listed but no information has been received by licensing to process the change in Manager.
Corrective Action(s): Please ensure a new Manager is appointed after being absent for more than 30 days. Notice of this change must be given to licensing to comply with the legislation.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: During the inspection licensing asked where the emergency supplies were located. A small bag with minimal supplies was observed. No food and water was available in case of emergency. This is a repeat contravention from inspection #CLAN-BHXQ3E
Corrective Action(s): Please ensure there are sufficient emergency supplies to prepare for, mitigate, respond and recover in an emergency. Licensing recommends sufficient supplies for a 72 hour period.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: During the inspection licensing observed the attendance records. Three departure times were missing for the month of July.
Corrective Action(s): Please ensure the attendance records are complete including the arrival and departure times of the children in care.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Licensing reviewed the children's files. One child had a baby picture on file although the child was older than 2.5 years. This is a repeat contravention from inspection #CLAN-BNYVBK
Corrective Action(s): Please ensure a child's photo is current to ensure it is an accurate representation of the child. This may be required in case of emergency.

Comments

At the inspection dated July 28, 2021 there were 8 children, and 1 staff was present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by August 11, 2021. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the owner.

The following education/recommendations were provided:

-The reportable incident reporting procedure.
-The current COVID-19 protocols that are in place
-Active supervision

The inspection findings were reviewed with a staff member at the inspection. Due to the COVID-19 pandemic the inspection report and the risk assessment were completed at the Burnaby FHA office. The report was written in 1 hour and this is included in the report. A copy of these documents were sent to the owner.
