Introduction

All areas of the community care facility (CCF) were inspected for compliance during an unscheduled routine inspection to assess compliance w/ the:
• Community Care & Assisted Living Act (CCALA)
• Child Care Licensing Regulation (CCLR)
• relevant Director of Licensing Standards of Practice (DLSP)

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: The manager was unaware of the requirement to document inspections (daily, monthly, & annual), maintenance, & repairs pertaining to the outdoor play space.
Corrective Action(s): This is a requirement of the Director of Licensing Standard of Practice (Safe Play Space): Maintenance of Equipment.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 3 employees' CRCs are pending (the manager has applied for them recently). 3 employees hold a CRC from another organization.
Corrective Action(s): The licensee must apply for a CRC share for the 3 employees whose CRCs are from another organization. Employees w/o a valid CRC or shared CRC must not work alone w/ children or assist w/ diapering/toileting.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: 3 employees lacked references.
Corrective Action(s): References must be obtained & checked prior to employment.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: 2 employees lacked a copy of their work history.
Corrective Action(s): A record of employees' work history must be obtained prior to employment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: 4 employees lacked their immunization status.
Corrective Action(s): Employees' immunization status must be obtained prior to employement.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: 4 employees' ITE, ECE, or ECEA certificates haven't been verified.
Corrective Action(s): 1 employee's certificate was verified today, as FHA showed the manager how to do this. Any ITE, SNE, ECE, or ECEA certificate must be verified prior to hiring, & upon every renewal.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: The last fire drill was observed to be practiced in Feb/2019.
Corrective Action(s): All employees must practice implementing the fire drill system monthly.
Date to be Corrected: 31/May/2019

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: There was no record of a practiced implementation of the emergency plan.
Corrective Action(s): All employees must practice implementing the emergency plan annually.
Date to be Corrected: 30/May/2019

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: The active play policy haven't been developed yet. The manager was unaware of this requirement.
Corrective Action(s): The policy is required, as per Standard of Practice #3 of the Director of Licensing Standard of Practice (Active Play).

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Several children's files lacked their immunization status & MSP #.
Corrective Action(s): Children's files must be complete by their 1st day of care.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Some children lacked their medical practitioner's contact information.
Corrective Action(s): Children's files must be complete by their 1st day of care.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: A child requiring extra support lacked a care plan.
Corrective Action(s): FHA provided a resource for the licensee to use. The care plan must be developed in consultation w/ the child's parent.
