Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The facility licence and name of the manager are not posted.
Corrective Action(s): Please ensure the facility licence and the name of the manager are posted.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: References for one staff person have not been checked.
Corrective Action(s): Please ensure references are checked for all staff and that evidence of the checks is available.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one staff person.
Corrective Action(s): Please ensure immunization status is available for all staff.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: An ECE certificate for one staff person has not been verified.
Corrective Action(s): Please ensure all ECE certificates are validated.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: A medical insurance plan number was not available for one child.
Corrective Action(s): Please ensure a medical insurance plan number or BC Care Card number is available for all children.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Start dates were not available for three children.
Corrective Action(s): Please ensure a start date is available for all children.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: One file had no emergency contact and no contact information for a doctor and one file had no phone number for a doctor.
Corrective Action(s): Please ensure contact information for a doctor/medical clinic and an emergency person is available for all children.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: A care plan does not include the course of action recommended by health care professionals for a child requiring additional support.
Corrective Action(s): One child has a care plan that does not include information regarding the child's food sensitivity and does not include specific instructions to guide staff actions regarding other areas of the child's support needs.
Date to be Corrected: Please ensure the care plan includes instructions for staff to follow when providing care to children who require additional support.


Comments

Summary of Inspection
At the inspection dated October 4, 2021 there were six children and one staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written off site. A copy of this report will be emailed to the manager. Time spent includes office time.
The following were discussed:
Staff and children's files must be complete before a child attends the program or a staff starts work.
Care plans need to contain enough information to guide staff actions when caring for the child.
Signing care plans by the parents.
