Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

Policies and Procedures
Care and supervision/Hygiene and medication
Nutrition
Program
Child Records and reporting

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Contraventions

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Review of staff files indicated documentation of reference check completion is missing for 2 staff. Names of references were on file.
Corrective Action(s): As per requirements and discussion, please ensure record is maintained of reference checks for staff.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Five staff files were reviewed and a record of immunization status is missing for one staff.
Corrective Action(s): As per requirements,please ensure all staff documentation is complete prior to employment of staff.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Staff schedule for the GCC (30 mos to school age) Program does not meet compliance with CCLR, schedule E as there is no ECE qualified staff. The staff has completed the ECE course and is waiting to receive the ECE Certificate from the ECE Registry.In the GCC (under 36 mos) Program, the staff plan also does not meet CCLR requirements as there is no IT Educator between 4:00 to 6:00 PM.
Corrective Action(s): As discussed, please ensure staff plans meet CCLR, Schedule E qualification requirements at all time or have an exemption approval in place for the proposed plan.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: Care plan Information is available to guide staff in providing extra support to children requiring it, however all plans are not dated and thus unable to assess if they are current, and/or require a review if they were developed more than a year ago.
Corrective Action(s): As discussed, please ensure there is a current plan signed and dated by parents to ensure plans are current, and subsequently reviewed at least annually or more often if there are any changes.

Comments

The operation of the facility is in compliance with the current Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above.
The Manager was on site today to assist with the inspection.
Licensing observed the following:
- In the Group Child Care (GCC) (30 mos to school age) Program there were 15 children in care with 3 staff
- In the GCC (under 36 mos) Program, Infant Room, there were 8 children in care with 3 staff
- In the GCC (under 36 mos), Toddler Room, there were 9 children with 3 staff

Discussions took place with the Manager/Licensee/Staff regarding the following:
- Staff qualification requirements for all programs
- Reportable Incident notification
- Active Supervision
- Potential risk of lead in drinking water
- Log book records

Resources provided:
- Safety Alert regarding Active Supervision
- Bulletin for Field Trips
- Reportable Incident Forms

At present there are no Exemptions/temporary placements in place.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection may be conducted due to the number and nature of the contraventions.
