Introduction

An unscheduled routine was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). Evidence for this report was based on the licensing officer’s observations, review of the facility records, and information provided by the facility staff at the time of inspection.
The following areas were reviewed:

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection, and a 3 year ‘historical’ review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #JCHE-A5YUXU have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing requested to view 2 staff files. It was found that 1 staff was missing all record of documentation on site. The staff stated that they had provided the information upon hire. Manager stated that it may be at Head office. Licensing notes that this is a repeat contravention.
Corrective Action(s): Please ensure that all documentation is complete and available prior to Staff returning to work at the facility.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing requested to view 2 staff files. It was identified that there were no references available for either staff file. 1 staff person stated that she sent it to Head Office but did not have a copy available to view today.
Corrective Action(s): Please ensure that all staff are screened prior to employment and complete documentation is available to view. Please ensure that staff documentation is complete and that staff are screened prior to employment.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Please refer to contravention 19(1)(a)
Corrective Action(s): Please ensure that all staff documentation is complete and available prior to staff working in the facility.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Licensing requested to view 2 staff files. It was found that 1 staff did not have any documenttion showing that the person was screeded prior to employment. The staff person stated that it was sent to head office but no documentation showing that the staff was screened prior to employment was available.
Corrective Action(s): Please ensure that all staff are screened prior to employmwnt and documentation is available for Licensing to view. Please ensure that this documentation is available pprior to the staff returning to work with the children.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Licensing reviewed 2 staff files and it was identified that 1 staff persons documentation was missing. Staff stated that they had provided this information upon hire but the Manager stated that there were no copies available.
Corrective Action(s): Please ensure that all staff documentation is available to view upon request by Licensing. This documentation must be available prior to the staff returning to work with the children.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: Licensing identified that there were 3 children requiring care plans and it was confirmed by the Manager that there are no care plans available.
Corrective Action(s): Please ensure that all children who require extra support have a current care plan in the file. The intent of a care plan is to guide and direct staff actions should the child need extra assistance.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: Licensing reviewed 5 children's files and it was found that at least 3 children were requiring a care plan with special instructions from a parent to guide and support staff actions, but none were available. Manager stated that she was aware that there were no care plans and would be working to correct this with the parents.
Corrective Action(s): Please ensure that any child that requires extra support has a care plan developed in consultation with the parent or any person requested by the parent

RECORDS AND REPORTING: 19280 - CCLR s.58(3)(b) - The licensee must record compliance with the care plan of a child requiring extra support in respect of each of the following that are applicable to the child: (b) any medication administered to the child by the licensee, including the amount and the time at which the medication was administered.
Observation (CORRECTED DURING INSPECTION): Licensing reviewed the medication storage and it was found that there was medication that did not have a record of consent to administer medication. The manager stated that she was not aware that it was not completed.
Corrective Action(s): Please ensure that a record of compliance with a care plan of a child requiring extra support in respect to the administration of medication including time and amount as to which the medication was administered is completed.
