Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: One staff certificate was not posted in a prominent place. This is a repeat contravention from inspection # CLAN-BJ5PNW and #CLAN-BTYVSW
Corrective Action(s): Please ensure staff certificates are posted in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following during the inspection:
-A climber in the playground was placed 3 feet from the fence. A climber must have a fall zone of 6 feet. This is a repeat contravention from inspection # CLAN-CCBNLT.
Corrective Action(s): Please ensure a healthy and safe environment is provided to the children at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following during the inspection:
-Two dents in the wall. This is a repeat contravention from inspection #CLAN-C9Y2VX
-Two paper towel dispensers were jammed and not working
-Duct tape was on the edge of the carpet (duct tape is difficult to clean)
-Paint chips were observed on the shelves. This is a repeat contravention from inspection #CLAN-BJ5PNW and #CLAN-C9Y2VX
Corrective Action(s): Please ensure the facility and equipment in the facility are in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following in the facility:
-Wasp chemical treatment was under the sink. A lock was present but was not applied. This was removed during the inspection.
-Staff bags were observed on two shelves. These were within reach of the children's in care and could contain items that could potentially be hazardous to the children's health and safety. This is a repeat contravention from inspection #CLAN-BJ5PNW, #CLAN-BTYVSW, #CLAN-C9Y2VX , #CLAN-CCBNLT.
-Multiple bottles of sunblock were located in a bin on the counter within reach of the children. This is a repeat contravention from inspection #CLAN-C9Y2VX.
Corrective Action(s): Please ensure children do not have access to any objects or substances that may be hazardous to their health and safety.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Two staff certificates posted on the wall were expired. Current certificates were not obtained. Licensing reviewed the staff records and the current certificates were not present as they are currently in process.
Corrective Action(s): Please ensure staff certificates are current

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: Licensing reviewed the children's records for one of the rooms for children 30 months to school age. Three children present were under 36 months. A maximum of two children under 36 months is permitted in one room as outlined in the legislation.
Corrective Action(s): Please ensure the children are divided into groups according to the legisltion.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: Licensing observed the contents of the first aid kit. Items with a drug identification number (DIN) were present in the first aid kit. Permission for applying this medication is required prior to application.
Corrective Action(s): Please ensure written permission is obtained from a parent or guardian prior to the administration of any medication

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Six children's records were reviewed. One children's record was missing an emergency contact other than the parent. This is a repeat contravention from inspection # CLAN-BY2UHS and #CLAN-BTYVSW
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Licensing reviewed a care plan on file. The care plan was not reviewed annually with the parent as a date and signature were not observed on the care plan.
Corrective Action(s): Please ensure the care plan is signed and dated by a parent or guardian to document that this has been reviewed and signed annually.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Licensing observed that a staff record was not present at the facility. In discussion with the Manager she stated that she was unaware that a staff record was required for a specific employee.
Corrective Action(s): Please ensure staff records are present at the facility prior to the employee starting work at the facility.

Comments

At the inspection dated December 5, 2022 there were 64 children, 18 staff, 1 practicum student and the Manager was present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by December 20, 2022 unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Manager.

The following recommendations were provided:
-The reportable incident reporting procedure. Forms and the bulletin were given
-The current cleaning protocols that are in place
-Reviewing the safe release policy
-Adding more items to the first aid kit such as tweezers, scissors and medical tape
