Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the manager is not posted in the facility.
Corrective Action(s): Please ensure the name of the manager is posted in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The following were observed during this inspection: cloths used to dry hands were stored in a manner that they were touching each other in the infant/toddler bathroom, perishable food in children's lunches was not being stored in the fridge, a fridge in the infant/toddler program was 12.5c, staff in the 3-5 program are not using the 3 sink method to wash dishes.
Corrective Action(s): Please ensure cloths for drying hands are stored so they do not touch each other, fridge temperatures are between 0-4c, perishable food is stored in the fridge and that the 3 sink method is used to wash dishes if no dishwasher is available.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During this inspection the following were observed: a strip of transition wood between carpet and laminate flooring in the 3-5 program was missing, peeling paint in the 3-5 bathroom, the bathroom floor and walls in the 3-5 room are in need of cleaning, walls in the hallway by the 3-5 bathroom are in need of cleaning
Corrective Action(s): Please ensure the facility is clean and in good repair at all time.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: The following were accessible to children: medication in a cubby in the 3-5 program, air freshener in the infant/toddler bathroom.
Corrective Action(s): Please ensure children do not have access to hazardous items.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Criminal record checks were not available for two staff. The licensee contact stated these had been applied for but not received.
Corrective Action(s): Please ensure a valid criminal record check is available for staff before they start to work.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Evidence of reference being checked was not available The licensee contact said she does call references although notes of the checks are not kept.
Corrective Action(s): Please ensure evidence of reference checks are available.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for two staff persons.
Corrective Action(s): Please ensure immunization is available for all staff.

STAFFING: 12151 - CCLR s.19(5)(a) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.

Corrective Action(s): Please ensure a criminal record check is available for the volunteer.

STAFFING: 12152 - CCLR s.19(5)(b) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (b) character references in respect of the person.
Observation: A minimum of two character references were not available for a volunteer.
Corrective Action(s): Please ensure references are available for the volunteer.

STAFFING: 12153 - CCLR s.19(5)(c) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (c) evidence that the person has complied with the Province's immunization and tuberculosis control programs.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Staff stated that an emergency drill had been conducted although it had not been recorded.
Corrective Action(s): Please ensure all emergency drills are recorded.

RECORDS AND REPORTING: 19140 - CCLR s.57(2)(h)(i) - A licensee must keep, for each child, a record showing the following information: (h) any special instruction respecting the child's diet, medication, participation in a program of activities, or other matter relevant to the child's care, (i) given by the child's parent to the licensee in writing.
Observation: Medicated cream was at the facility for one child although written permission to apply the cream had not been obtained.
Corrective Action(s): Please ensure written permission to administer this cream is obtained.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: No care plan is available for a child requiring extra support who requires medication. The manger said the family had told the staff when to use the medication although no written plan was available.
Corrective Action(s): Please ensure a care plan is available for all children requiring extra support.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Care plans for three children did not have evidence of being reviewed annually with the parent or any person requested to by the parent.
Corrective Action(s): Please ensure all care plans are reviewed at least once every 12 months.

Comments

Summary of Inspection
At the inspection dated June 13, 2023 there were 33 children and seven staff present. The Licensing Officer met with the licensee contact and the manager. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and licensee. A copy of this report will be emailed to the manager.
The following were discussed:
Ensuring bleach and water bottles are labelled with the contents.
Ensuring expected time out and actual time out are easily identified on the time in/out sheet in all programs.
Ensuring children are accurately signed in/out of rooms when the programs are combined at the end of the day.
Ensuring all staff are aware of and can implement the facility policies and procedures.
