Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). There were 27 children and 6 staff at the facility during the inspection. All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The manager's name was not identified in any display available within the facility.
Corrective Action(s): Ensure the manager's name is displayed in a prominent place in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection the following was observed:
-the fridge in one of the two programs was measuring at 8 degrees Celsius, where the children's lunches/snacks are stored
-A large dome shaped climber was present in the outdoor playspace and had less than 1.82m of space around the edge of climber making the fall zone restricted and greatly increasing the risk of injury to children. The climber was reported by staff to be used by the Infant/Toddler program sometimes
-In the infant/toddler outdoor play space, there were several strips of astro-turf (grass carpet) with approximately 50% of the edges of the strips raised, exposing the wood chips below and creates choking and tripping hazards for infants and toddlers
Corrective Action(s): -Ensure all fridge temperatures are kept between 0-4 degrees Celsius to keep children's foods at safe temperatures
-The licensee is responsible to ensure there is a minimum of 1.82meters around the edges away from the climbing structure to any and all hard surfaces (Such as fences, cement, the step down from the upper playspace to the lower, etc), as well as under the climber. Ensure there is an adequate fall zone to reduce risk of injury to children in care.
-The climber is not appropriate for use by the I/T program as it measures taller than 0.9m, is required to no longer be used for the Infant/toddler program
-Ensure all of the astro-turf (grass carpet) are not lifting at the edges to reduce the risk of falls and exposure to wood chips for infants and toddlers

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: -In the bathroom of the I/T program, there were a mop/bucket and vacuum in reach of children.
-In the outdoor play space there were several pallets with exposed rusty nails and sharp, jagged edges, in reach of children.
Corrective Action(s): Ensure the children in care do not have access to items which could be hazardous or dangerous to their health and well-being.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Three staff files were reviewed during this inspection. In one of the three staff files, there was no evidence of a criminal record check. Staff informed licensing that the criminal record check form "just needed to be printed", but did not have access to have it printed during the inspection. The two other staff criminal record checks were not site specific, but were addressed to the previous owner/facility.
Corrective Action(s): Ensure all staff employed have a valid criminal record check available within their staff files, which is addressed to the current owner and facility.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Three staff files were reviewed and two of the files did not have evidence of the staff's immunization status available.
Corrective Action(s): Ensure all staff have provided evidence of their immunization status.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: There was no evidence of fire drills have been completed in January and February 2022 in one of the programs. The manager stated all fire drills had been completed, but not recorded.
Corrective Action(s): Ensure there is evidence of a monthly fire drill completed for all programs at the facility.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: One child in care had a medication to be administered, but there no evidence of permission or instructions to administer from the parents within the facility.
Corrective Action(s): Ensure all medications to be administered have permission and instructions by the parents provided to the facility.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Six chldren's files were reviewed and in one of the six files, there was no evidence of an emergency contact available.
Corrective Action(s): Ensure all children's files have evidence of at least one emergency contact (who is not the parent).

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: Six children's files were reviewed, and in one of the six files, there was no evidence of a care plan as related the child's need for extra support. In discussion with staff, it was discussed there were two additional children who attend the facility, and who did not have care plans available onsite, as related to the children's needs for extra support.
Corrective Action(s): Ensure all children in care who require extra supports have the appropriate care plans available to guide the staff in how to care for those children.
