Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 2 of 3 staff persons did not have a current criminal record check completed by the Criminal records review program. 1 of the 2 staff persons had the criminal record check completed by the RCMP
Corrective Action(s): Ensure that each staff person has a criminal record check completed by the criminal records review program.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: 1 early childhood educator certificate was not verified. This is a repeat contravention
Corrective Action(s): Ensure each person employed has their early childhood educator or assistant certificate verified using the system established and maintained by the director of the early childhood educator registry.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: No fire drill was completed in January 2021
Corrective Action(s): Ensure that each employee practices implementing the fire drill system at least once each month.

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation: The Manager identified a reportable incident that was not reported to the Licensing Officer.
Corrective Action(s): Ensure that a reportable incident is reported to the Licensing Officer within 24 hours.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: 5 of 15 children had photos that could not be used to readily identify a child based on the age of the photo. 10 of 15 children did not have a photo or digital image to readily identify the child.
Corrective Action(s): Ensure that each child has a photograph or digital image that can readily identify the child in an emergency.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: a care plan was not reviewed within the last year.
Corrective Action(s): Ensure that each care plan is reviewed at least once per year.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: The Managers employee file was not available for review at the time of the inspection
Corrective Action(s): Ensure that each record referred to in sections 56-58 is kept at a single location in the community care facility.

Comments

Summary of Inspection
At the inspection dated February 16, 2021 there were 12 children and 2 staff present. The Manager arrived at 3:15pm. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provided a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
· Promoting Active Play in the program
· Non-reportable incident log
· Medications
· Active Supervision
