Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A minimum of 3 character references were not obtained for the Manager.
Corrective Action(s): Please ensure the Manager have a minimum of 3 character references.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: There was no evidence that a certificate was verified by the early childhood educator registry.
Corrective Action(s): Please ensure certificates are verified by the system maintained by the early childhood educator registry.

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: Staff on site did not have a current first aid, it is expired.
Corrective Action(s): Please ensure that children have access at all times to an employee who holds a valid first aid and CPR certificate.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Criminal Record Check is not current for one staff, it is expired.
Corrective Action(s): Please ensure Criminal Record Check is current.

Comments

At the inspection dated October 05, 2023 there were 8 children and 1 staff present. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed. This inspection and the risk assessment were written on site and reviewed with the Manager, a copy was provided via email.


The following education/recommendations were provided:
- Care plans and medications.
- Medication storage.
- Storage of children’s food.
- Maintaining staff file.
