Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION): During this inspection a door in one infant/toddler room was propped open with a chair. There was no barrier to prevent children going out of the door.
Corrective Action(s): The door was closed during this inspection.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Site specific criminal record checks were not available for three staff.
Corrective Action(s): The manager said these had been applied for but not received.

STAFFING: 12151 - CCLR s.19(5)(a) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.
Observation: A criminal record check was not obtained for three volunteers. The manager stated criminal record checks are conducted by the school the volunteers attend although she has not seen copies
Corrective Action(s): The manger will ensure criminal record checks are available for all volunteers.

STAFFING: 12152 - CCLR s.19(5)(b) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (b) character references in respect of the person.
Observation: A minimum of two character references were not obtained for three volunteers.
Corrective Action(s): The manager will ensure all volunteers have a minimum of two character references.

STAFFING: 12153 - CCLR s.19(5)(c) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (c) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for three volunteers.
Corrective Action(s): The manager will ensure immunization status in on file for all volunteers.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: A care plan has not been developed in consultation with the parent or any person requested by the parent for one child. .
Corrective Action(s): The manager will ensure a care plan is available for the child.

Comments

Summary of Inspection
At the inspection dated March 14, 2024 there were 48 children and 12 staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written on site. A copy of this report will be emailed to the manager.
The following were discussed:
All bottles of cleaning chemicals need to be labelled with the contents of the bottle.
A solution that sanitizes is required in all programs.
Area of children bathrooms are becoming cluttered with staff belongings and in some areas are in reach of children.
Ensuring children's files contain details of a potential reaction of a parent says a child has a sensitivity.
All items with DIN or NPN numbers must have parental permission before they are administered and must have a current expiry date.
Ensuring all undersink cupboards are locked when children are present.
Ensuring all facility policies are followed.
Ensuring children do not have access to items in program room fridges that belong to staff.
