Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11060 - CCLR s.14(2) - A licensee must have one toilet and wash basin for every 10 children or fewer.
Observation: There are sufficient washrooms for all programs, however at time of inspection one of the washrooms in the Group Child Care (30 mos to school age) program had equipment and supplies stored in it and thus was not available for use. Staff stated it is normally used and that equipment was placed in it just yesterday.
Corrective Action(s): Please ensure all washrroms are available for use by children as per requirements.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: All 5 staff files had a current record of Criminal Record Check (CRC), however for one staff the CRC was not specific to this site, it was a copy from another agency.
Corrective Action(s): As discussed,please ensure CRC is obtained specific to this facility.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Reference checks were missing for one staff who has started employment recently.
Corrective Action(s): Please ensure staff screening documentation is all complete prior to employment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Record of imminization status missing for one staff.
Corrective Action(s): Please complete all documentation as per requirements.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Five staff files were reviewed and all documentation for staff was complete staff qualification validation has not been completed for 4 staff.
Corrective Action(s): Discussion took place regarding requirement for validation for all certificates issued by the ECE Registry. Manager indicated she was not aware of this requirement and will now complete as required.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: At time of inspection staff qualifications and ratio of staff was in compliance, however review of the staff schedule indicates qualification of staff is not in compliance in the Group Child Care (under 36 months) program on days when there are more than 12 children in care and both program rooms are in operation as there is only one IT Educator staff. In addition, there is no IT Educator scheduled from 4:30--5:30 PM.
Corrective Action(s): Staffing requirements discussed with Manager, and Manager indicated Licensee will submit application for exemption for the staff plan.

RECORDS AND REPORTING: 19052 - CCLR s.56.1(2)(b) - A Licensee must keep (b) a current record of each person to whom the written agreement is delivered in accordance with that section [CCALA s.19]
Observation: Prepayment agreement indicating parent has received information regarding all policies including prepayment is missing for one child.
Corrective Action(s): Please ensure records are complete for all children.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: All emergency consent cards were reviewed and 12 registration records for children were reviewed and following information was missing: photos for 6; care card # for 6; Dr.'s name & number for 5; emergency contact name & number for 6 .
Corrective Action(s): Manager stated some of the records reviewed were for children who have not yet started attending. Please review all children's records and ensure they are complete, and recommend files for those not attending be noted as such or filed separately.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: Staff in the program were aware of a child who needs medication periodically and a medication consent is complete, however a Care plan is not in place.
Corrective Action(s): Please complete as per discussion.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

The Manager was on site to assist with the inspection.
Staff to child ratio was in compliance with regulations with the exception of that noted above.
Upon arrival Licensing observed the children from both programs were outside, and staff maintained active supervision of the children and provided assistance when required. Upon coming inside the children were engaged in free play, dancing and having lunch. Staff was observed interacting with the children using positive communication and engaged in their activities.

Discussions with the Manager
- Discussion on active supervision and information regarding Bill 5, and Manager stated she has not received it, info to be resent.
- Discussion Re: Lead in drinking water
- Discussion Re: RI reporting
- Log book records to include signatures of staff writing and notification to parents.


A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
