Introduction

An unscheduled inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing noted dog feces in several locations along the walking path that leads to the outdoor play area
Corrective Action(s): Ensure all animal feces are removed prior to accessing the walking path

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: During file review prior to inspection, Licensing noted several photos provided by the Licensee to licensing after that last routine inspection displaying a clean/clutter free kitchen area. It was noted during today's inspection that the kitchen area has returned to the same level of clutter on the kitchen counters impacting on the overall cleanliness of the facility
Corrective Action(s): Please ensure the facility, any fixtures, appliances and equipment remain at all times in good repair and that the environment is clean for children's use

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Upon file review it was noted that CRC clearance letters in the facility file have expired. Licensing noted at last routine inspection Licensee was informed of the CRC expiring the following year. Upon arrival to the licensed facility, LO enquired about the CRC applications. The Licensee stated that both CRC letters were applied for in July 2018. The licensee was able to produce copies of the application forms for both residents, however it would appear that the applications were not processed. Licensing explained that once the application is received by the CRC review agency in Victoria, an email will be sent to the applicant with further instructions, the Licensee is unsure if this email was ever received. Therefore, currently the Licensee is operating without a valid Criminal Record Check. One other resident CRC expires as of January 31, 2019.
Corrective Action(s): Please contact the Criminal Records Review agency to enquire as to why the applications were not processed.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing enquired about the review and recording system for the emergency supplies located in the shed. Licensee states that a recording system has been implemented however was unable to produce the record for Licensing during this inspection
Corrective Action(s): Please ensure you have developed and utilize a recording system for emergency supplies, to ensure that no food items have expired and require replacing

POLICIES AND PROCEDURES: 13090 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: Pet policy in place states that dogs will not be present in the kitchen and will be crated, 2 dogs, 1 was in the kitchen and 1 was withing the eating area while the children were preparing for snack. This again has been identified as an area of non-compliance along with concerns related to health and hygiene of this practise.
Corrective Action(s): Please ensure policies are current and followed as written; ensuring the pets remain outside of areas where food is being served and/or prepared

Comments

At the inspection dated January 30, 2019 there were 5 children and 1 staff present. At this inspection the above noted contraventions were identified . Please provide Licensing with a written response by January 31, 2019 indicating how the contraventions have been addressed.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
