Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP).
All care categories were inspected for compliance.
Covid - 19 prevention strategies were in place

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: On review of 3 staff files, Licensin gobserved one staff only had an RCMP check in place. The Licensee said that she thought an RCMP check was exactly the same.
Corrective Action(s): Please ensure criminal record checks are obtained through the Criminal Records Review Program in Victoria. This staff must not work alone without an approved health and safety plan.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: On review of 3 staff files, Licensing observed 1 missing a character reference. All staff require at least 2 references as part of the screening process
Corrective Action(s): Please ensure staff are fully screened prior to employment

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: On review of 3 staff files, Licensin gobserved one file that had an expired validation in place. The staff certificate had been renewed since and new validation had not been obtained.
Corrective Action(s): Please ensure staff files are complete with required information as per Section 19 of the CCLR

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: The care plans were not reviewed annually with the parent or any person requested to by the parent. All care plans contain the required information. Manager is aware that this has yet to be completed but confirmed they were made in consultation with the parents/.
Corrective Action(s): Please ensure annual review is complete. Licensing recommendsh a parent signature and date of review.

Comments

Summary of Inspection

At today’s inspection there were 9 children in the 3-5 program with 2 staff present and 3 children in the I/T program with 1 staff.

At this inspection the above noted contraventions were identified.
The Licensee is required to submit a compliance plan to be reviewed by Licensing

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

The following was discussed:
- Movement between the programs - maintaining accurate attendance records and ensuring parents are aware.
- Licensing Duty line: #604 587 3936 for emergencies if area Licensing Officer can’t be contacted.
- Regular review of BCCDC website for COVID-19 updates (see link below)

The facility has been receiving Licensing Officer’s emails.
