Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed that the paint is peeling on the outdoor play area equipment located at the back of the property.
Corrective Action(s): Ensure that the paint of the outdoor play area equipment is not peeling and in good repair while children are in attendance.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing observed that one staff did not have any character references on file.
Corrective Action(s): Ensure that the staff has character references on file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing observed that one staff did not have their ECEA certificate verification on file.
Corrective Action(s): Ensure that staff's certificate is validated using the system established by the ECE Registry. This item was identified and contravened on June 12, 2019 on routine inspection report #CLAN-BD3SRR.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Although staff said during the inspection that the fire extinguishers have been addressed and serviced on-site a few months ago this year, Licensing observed that the next service due date for the fire extinguishers was on May 5th, 2021. This item was identified and contravened on April 14, 2020 on routine inspection report #CLAN-BNPUQR.
Corrective Action(s): Ensure that fire extinguishers are always serviced prior to the next service due date listed on the tag.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed that there were some months where the fire drill was not completed and recorded. This item was identified and contravened on June 12, 2019 on routine inspection report #CLAN-BD3SRR.
Corrective Action(s): Ensure that fire drills are completed each month and recorded.

Comments

At the inspection dated Aug. 16, 2021 there were 27 children and 6 staff present. At this inspection the above noted contraventions were identified. Actions required by the licensee includes providing a written response to Licensing addressing how the above noted contraventions have been corrected.
As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
A COVID-19 Risk Screening was also completed.
A business card was provided to the facility.

The following education/recommendations/discussions were provided:
- Continue to follow COVID-19 Policy
- Continue indoor ventilation
- Continue cleaning and sanitizing the facility including toys and equipment
- Regularly check expiry date of items in the emergency supplies bag
- Removing items with a DIN number in the first aid kit

*All inspection findings were reviewed with the facility on-site at the routine inspection.
