Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: one early childhood educator certificate was not posted.
Corrective Action(s): Ensure that each certificate is posted.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: There are many areas in the facility that have painted chipped and exposed drywall.
The flooring in the 3-5 bathroom is beginning to become unattached.
Corrective Action(s): Please ensure that the drywall is not exposed to children and the floor in the bathroom is repaired to allow for cleaning.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: the emergency exit leading from the infant room to the 3-5 room was locked with a lock at the top of the door on the infant side and blocked with a shelf on the 3-5 side.
The front door was locked with a sliding lock at the top hampering the exit in case of a fire.
Corrective Action(s): Ensure that the exits are not blocked or hampered.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: The door to the staff washroom and cleaning supply room was unlocked and accessible to children.
Corrective Action(s): Ensure that children do not have any access to hazardous to health and safety

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The Manager said they completed an emergency drill in the last year but did not write it down
Corrective Action(s): Ensure that the emergency drill is recorded.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: The Manager was unable to locate a policy or procedure for the away play space.
Corrective Action(s): Ensure that a current record of polices and procedures to guide staff in the care and supervision of children on the way to and at the away play space is available.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: The Manager confirmed that they a responsible adult was working in place of an early childhood educator for more than 30 days. The requirements were discussed when a staff leaves they have 30 days to replace with staffing according to schedule E.
Corrective Action(s): Ensure that the staff to child ratio is no less than schedule E.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Two staff files were not available during the inspection. The Manager went to the other facility to get them.
Corrective Action(s): Ensure that all records in sections 56-58 are kept in a single location in the community care facility.

Comments

Summary of Inspection
At the inspection dated August 2, 2022 there were 26 children and 5 staff present. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and submit a written response to the Licensing Officer by August 17, 2022. The Licensing Office will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
· Cleaning Schedules
· Create and submit a playground schedule
· Active Supervision
· Lead in the Water
