Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed that the blue cabinet that stores hot water tank was not locked.
Corrective Action(s): Ensure that the safe environment is provided at all times while children are in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: The hot water accessible to children in the bathroom recorded the reading of more than 49 degrees Celsius.
Corrective Action(s): Ensure that any heated water accessible to children is heated no more than 49 degrees Celsius.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Criminal Record Check on file is not site specific.
Corrective Action(s): Ensure that the licensee initiates the process of obtaining a site specific CRC and includes in the staff file.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one or more employees.
Corrective Action(s): Ensure that the immunization status is obtained for the employees before the employee starts working in the daycare.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: The copy of the validation of the ECE certificate was not included in the staff file.
Corrective Action(s): Ensure that the certificates are verified by the system maintained by the early childhood educator registry.

Comments

Summary of Inspection:
At the inspection dated February 13, 2022, there were 5 children and the licensee present. At this inspection the above noted contraventions were identified. Licensee is required to submit a corrective action plan to address the contraventions.
The following was discussed or education provided:
Emergency supplies kit to include the updated Emergency permission cards.
To ensure that the green fencing is repaired wherever its coming off. Licensee informed that they are working on replacing green fencing with wooden lattice.
