Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

Nutrition

Child Records and reporting

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Contraventions
Previous Inspection -
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: On review of staff files, Licensing observed that one staff was missing immunization status.
Corrective Action(s): Please ensure all staff documentation is in place prior to employment.

STAFFING: 12150 - CCLR s.19(4)(b) - A licensee must not employ a person in a community care facility as (b) a responsible adult unless the person has the qualifications required under Division 2 [Employee Qualifications].
Observation: Licensing observed through staff files and conversation with the Licensee/Manager that a new staff does not have qualifications on file to meet Responsible Adult status. Discussed the screening process of the Licensee in relation to any new staff. Licensing will approve a staff exemption until 20 hours of training can be identified.
Corrective Action(s): Please ensure all staff have the appropriate qualifications required to work in this setting.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: On review of a random selection of children's files, Licensing observed that 3 were missing digital images. Licensee is aware and stated that as it is the beginning of the school year, some records are only just being supplied.
Corrective Action(s): Please ensure a digital image is on file for all children in case of an emergency situation.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was the Licensee/manager with 2 staff and 19 children. 1 staff is in training at the facility.
Staff to child ratio was in compliance with regulations
Programming and information is posted and available for parent review. Outdoor play is a daily occurrence and Active Play and Screen Time policies are now in place and available to staff and parents.

Licensing observed Staff engaged with children using appropriate language and guidance techniques.
Licensing observed the children during group circle games which encourage children to use memory recall and cooperating with one another. Snack time was available for children whenever they required.
Children participated in free play activities and a variety of equipment and resources are available.

Discussions with the Manager/Licensee:-
- Licensing reviewed staffing qualifications with the Licensee/ Manager and Licensing will approve a staff plan exemption to meet regulations once submitted by the Licensee. Forms will be provided by email.
- Licensing provided information regarding immunization status as required by regulation.
- Also discussed was the CRC process. One staff is still awaiting clearance but Licensee has evidence of completion of required application. This staff is in training so is not left alone.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
No other concerns noted at today's inspection.
