Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), The Child Care Licensing Regulation (CCLR) and the Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation (CORRECTED DURING INSPECTION): Licensing observed that one staff certificate was not posted in the facility.
Corrective Action(s): Please ensure staff certificates are posted in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following:
-Loose cords under a light table
-Plastic bags under the sink in the washroom.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times to the children in care

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: The following was observed during the inspection:
-A large metal cart with sleep mats was partially blocking the emergency exit.
-Several shelves were placed close to the front door of one of the rooms and this made the corridor to the entrance of the facility much smaller. This was corrected during the inspection.
Corrective Action(s): Please ensure furniture and equipment are not blocking or partially blocking an exit.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: During the inspection Licensing reviewed the staff records. One staff record was missing a criminal record check (CRC) completed by the Criminal record review program.
Corrective Action(s): Please ensure CRC's are completed through the Criminal Record Review Program.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for two employees.
Corrective Action(s): Please ensure staff records are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for three employees.
Corrective Action(s): Please ensure staff records are complete.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed the emergency supplies for the facility. Food and water was observed. More supplies are required as outlined in the facility emergency policy
Corrective Action(s): Please ensure sufficient supplies are added to the emergency evacuation kit to be prepared in case of an emergency.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: During the inspection Licensing observed an item with a natural product number (NPN) in a child's cubby. Written permission from the parents or guardian is required prior to application.
Corrective Action(s): Please ensure to receive written permission prior to applying items with an NPN or a drug identification number (DIN) to a child.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: The children's records were reviewed. One children's record was missing an emergency contact other than the parents.
Corrective Action(s): Please ensure children's records are complete

Comments

At the inspection dated December 14, 2023 there were 33 children, 8 staff, and the Manager was present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by December 28, 2023 unless otherwise specified in the report. As part of the inspection the Facility Risk Assessment Tool is completed and a copy was provided to the Manager.

The following was discussed with the Manager:

-Reportable incident reporting.
-Lead in the water
-Items in the first aid kit had a drug identification number (DIN). Permission is required from a parent or guardian prior to application.
-Plants- A print resource will be sent to the Manager on plant awareness.
