Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP).
All care categories were inspected for compliance.

Contraventions

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following:
- Highchairs and table were visibly dirty and not cleaned prior to children's use
- Wheelbarrows were stored outdoors in the children's play space
- Dog feces were along walkways leading to outdoor play space
- Safety gates were not always secure, allowing children into inaccessible areas
Corrective Action(s): Licensee will provide a corrective action plan to address the concerns to ensure safety and cleanliness at all times and said that she hadn't had a chance to clean up.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed that fire drills were not always recorded with a good recording system in place. Licensee said that drills were practiced, including an earthquake drill. This was a repeat contravention.
Corrective Action(s): A sample emergency drill record sheet was provided for use going forward to ensure accuracy.

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation: Licensing observed a child/ren gain access to areas that were gated off as unsafe spaces, due to safety gates not being secured properly. A child was unsupervised when the unlocked front door was opened. The Licensee said she was expecting someone to stop by to drop something off but was in another room at the time.
Corrective Action(s): Please ensure that areas not to be accessed by children remain secure at all times.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed children not washing hands prior to eating food, and wandering around with food in hand. Dogs were observed to be around the children when eating.
Corrective Action(s): Please ensure that children practice a program which includes handwashing and appropriate methods of safe eating at a table/highchair without pets being in the food area.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Attendance records were not accurate for the number of children attending today and some departure times were not recorded on occasional days.
Corrective Action(s): Please ensure attendance records are accurate in case of an emergency situation.

Comments

At today’s inspection there were six children and the Licensee present.

At this inspection the above noted contraventions were identified.
The Licensee is required to address the contraventions to bring the facility back into compliance and provide a written response to Licensing by the date below.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

The following was discussed:
- Valid CRC/s were not available but had been applied for, for the Licensee.
- Outdoor play to be daily to meet active play requirements
- Hygiene and sanitization practices with the diaper change area
- Outdoor area to ensure depth of resilient surfacing when in use (currently in need of repair and gated off)
- Emergency evacuation plan to include secondary location during annual drill
- Audit of children's files to ensure each child has their own file and is not shared with a sibling (previously discussed)
- Recording observations for a child with behavioural issues
- Update of facility policies to ensure accuracy for families and include a pet policy
- Licensing Duty line: #604 587 3936 for emergencies if area Licensing Officer can’t be contacted.
