Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: 2 Early Childhood Educator certificates were not posted.
Corrective Action(s): Ensure that a copy of the certificate of any early childhood educator is posted.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The following was observed:
-The wall beside the circle area on floor 2 has gyprock exposed and the carpet in that area is beginning to fray.
-the bathrooms in both programs are visibly dirty around the sinks.
-the floor in the kitchen on floor 2 is visible dirty.
-the toilet on floor 2 has the top piece ducked taped.
Corrective Action(s): Ensure that the facility, furniture, equipment and fixtures is clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: The following was observed:
-mouse traps were observed in both programs with a label that it is hazardous. On floor 2 the mouse trap is accessible to children all the time and on floor 3 when the kitchen door is open.
-Lysol wipes were stored on the counter and shelf in the teacher bathroom, however the door was open and the bathroom accessible to children in care.
-a large paper cutter was located on a counter accessible to children on floor 3.
Corrective Action(s): Ensure that hazardous materials are not accessible to children in care.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 2 of 6 employee files reviewed did not contain site specific criminal record check.
Corrective Action(s): Ensure that each employee has a site specific criminal record check.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: 2 of 6 employee files reviewed did not show evidence that references were checked prior to employment.
Corrective Action(s): Ensure that each person employed has character references obtained.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: It was determined that a Responsible Adult or an Early Childhood Educator Assistant work in the programs without an Early Childhood Educator present on a rotating basis.
Corrective Action(s): Ensure that the staff to child ratio is no less than permitted in Schedule E.

MEDICATION: 16020 - CCLR s.53(1)(b) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (b) readily accessible to employees.
Observation: Medication was not readily accessible to employees.
Corrective Action(s): Ensure that any medication agreed to be given to a child is readily available.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: 1 of 15 children files reviewed did not contain immunization status.
Corrective Action(s): Ensure that each child has a record of immunization status.

Comments

Summary of Inspection
At the inspection dated December 2, 2021 there were 26 children, 7 staff, and a practicum student present. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
· Promoting Active Play in the program
· Ensure outdoor play time daily
· Active Supervision
· Lead in the Water
· Ensure that any updates to care plans is documented and parents have reviewed/signed off on it.
· Update parent handbook to include all policies and procedures including active play and screen use.
· Ensuring that the cleaning checklists are maintained.
· Discussed being transparent with the children in regards to the foods they are eating.
