Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

The following areas were reviewed:

Child Records and reporting

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

At time of this inspection all areas inspected were found to be in compliance with the exception of those noted below:

Contraventions
Previous Inspection - Contraventions observed on FIR #SREL-AT5QAW have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Three staff files were reviewed and the Criminal Record Check (CRC) required renewal for one staff in October 2017 and Licensing identified this on an inspection report in November 2017 and record now indicates the request for the CRC was sent to the Criminal Record Review Agency on Jan 8,2018 for renewal. A CRC from the Criminal Record Review Agency is also missing for one staff, however a consent is on file (dated Jan 8,2018) indicating it has been requested.
Corrective Action(s): Please ensure Criminal Record Checks (CRC) are completed for staff prior to employment and renewed every 5 years as per requirements. This is a repeat violation.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: All 3 staff are missing a record of verification of staff qualification certificates.
Corrective Action(s): As per requirements,please ensure all staff qualification certificates are verified and record is kept of the validation. This is a repeat violation.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation (CORRECTED DURING INSPECTION): At time of this inspection there were 12 children in care with 2 staff, one ECE and the other ECE Assistant which is in compliance wiht the requirements. However, when children went outside one staff remained inside for part of the children's outdoor play time to prepare lunch. The staff member stated there is usually a third staff here by this time and thus there is always 2 staff outside, however today the staff was away. The Manager arrived on site as children were coming inside.
Corrective Action(s): As discussed, please ensure staff ratios are maintained at all times.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Review of attendance record indicates time of departure is missing for some children. Parent sign in and out system is in use.
Corrective Action(s): Please ensure attendance record is completed as discussed.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Eleven registartion records and emergency consents were reviewed and all were complete with the exceptuion of missing photos or digital images for 2 children. Record indicated photos have been requested,
Corrective Action(s): Please ensure photos or digital image is available for all children as per requirements.

Comments

The following was also observed and or discussed with the staff and Manager:
--Programming is posted and available for parent review via a notice board - Program operates on a theme basis.
--The new policies required for Active Play and Screen Use are complete and posted on parent board. Manager made aware revision is required for Screen Use as providing 1 hour of screen use for School Age children is not in compliance with the new Director of Licensing Standard of Practice for Active Play which limits time to half hour maximum daily. Based on observations and schedule posted, facility meets requirements for providing outdoor play time. Children were outside for approximately 45 minutes and also go outside in the afternoon.
--Licensing observed Staff engaged with children during all activities and staff used appropriate language and guidance.
--Licensing observed the children engaged in free play, having snack, having book time, take part in circle, followed by outdoor play, and having lunch. --Children were observed washing hands prior to eating. Staff maintained supervision of children when the washroom was being used and staff ensure the water faucet at sink is set to ensure water temperature is safe as hot water temperature at times exceeds 49 degrees. At time of this inspection the water temperature measured 50.5 degrees Celsius.
--ECE Certificate posted for one staff is expired, however this staff was not working at time of this inspection, and another staff stated an application for renewal has been submitted to the ECE Registry. Manager made aware that an exemption is required if the renewed ECE Certificate is not received prior to this staff returning to work.
--Immunization Poster provided for posting

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
